So I sent a letter (used the templates from this sight which were VERY helpful) to 2 of the 3 pdl companies. One was to cease the automatic deduction, the other was to stop the automatic dedution AND to ask for a refund because I have way overpaid them. This is the reply I received from them (MTE):

e have received and reviewed your correspondence regarding your complaint with the
company.

model. This is based on sound advice from our legal department. In addition, the Legal
Disclosures provided for customer reference at our website state the following:

Regardless of where you may be viewing or accessing this site, you as the
borrower are responsible for complying with any local statutory obligations
that may exist in your state or area with respect to this transaction. The
Federal laws governing this consumer loan agreement may differ from the
laws of the state where you reside. If you do not want to enter into a consumer
loan agreement with us under our terms, then you should apply for a loan at
a provider located in the state where you live.

The money was lent to you in good faith with the understanding that you would abide by the
terms detailed in your loan contract. We upheld our end of the agreement by crediting the
funds to your account in a timely manner. The Loan Note and Disclosure that you e-signed
and thereby agreed to is very detailed and clear so as not to cause any confusion to the
borrower, and meets all the Truth-In-Lending and Reg Z requirements as prescibed by
Federal statute.

Due to the fact that you have revoked authorization on our debits, no further debits will be
made from your account.

Due to your long history with our company, and in the interest of good customer service,
we have agreed to waive all finance charges currently due on your loan. We will expect
complete payment of the principal amount owed.

The Lender will be prepared to provide you with the information necessary for repaying the
$250.00 that remains due on your principal balance. Payment must be received by you in
the form of a Cashier’s Check or Money Order payment. We expect this offer will bring us
to an amicable resolution.

Please acknowledge your understanding and acceptance of our proposal if you are in
agreement with the offer detailed above, and advise which payment method you will use.
Once your acknowledgement/agreement is received, we will provide you with the
information needed to make the payment. Once we have received this payment, we will
mark your account "Paid in Full."

If your response is not received within seven (7) days of the date of our offer, the offer will
become null and void and collection efforts will resume.

Thank you for your time and consideration in this matter.

I do want to write them back and let them know that they have been paid back and then some! But should I just settle with them instead?


I live in NJ. I want to reply to them, but am not sure yet what to say. I will do this tomorrow. I would love to contact that BIG-Int, but don't have a fax number for them! You can't email them either. I guess in 2 weeks when my account is closed they will call me. I am ready for them. They have taken full advantage and can try to call my employer. I am sick of worrying about this and losing money every 2 weeks. My own fault, I know. But they have been paid back.

This sounds almost exactly like the letter I received from 3Midland! I just emailed them back and told them they were not going to get any more money from me that I had overpaid them and I wanted my account PIF. The next email I got was where they were going to "turn me over to collections". With my complaint to the AG and then the BBB, I have not heard anything more about it.

guest, what was the original loan amount and how much have you paid them to date.. If the paid to date is more than the amount then here is what you do... counter back that you have already repaid the principal balance and ask them to refund the difference. If you have already done this or if you do and they do not accept, them reply to them that you are willing to settle your dispute and agree to no further action if they consider your account closed, paid in full. Remind them that if they do not accept and try and collect you will pursue action within your state to seek redress and punishment for their illegfal actions.

When you file your complaints with the ag, ftc, bbb, make sure that you attach any e-mails from the pdls and the cc the pdl so that they know a complaint has been filed against them. I have also filed complaits with Homeland Security - the department of ICE. The look into cyber crimes -cc the pdl with this complaint also.

I agree not to pay them any more money. They sent me to collections months after I defaulted with them. I had overpaid them and decided not to give them another dime. I sent them e-mails, faxes, and certified letters. They never responded to one and they even stalked me around the forums here. One day they flooded my inbox with a bunch of e-mails after I had filed a complaint with my AG. I filed another complaint with the DIF and they have been quiet since.

Thanks everyone for all your advice. (I am the guest, but failed to sign in before my post!) I am going to file complaints and also send back my reply advising I have paid them in full and will not request a refund or seek legal action if they mark my account paid in full. This should be interesting! Now if I could only obtain a fax number for that BIG-Int......

I just sent my rebuttal to MTE. I asked for my refund as requested in my original letter and advised if they choose to send me to collections that I will have no choice but to file complaints with the AG, BBB and NJ Dept of Banking and Insurance.
