I finally got a call from the loss prevention department of my bank..after writing them to explain the situation. (The ipdls continuously debited my account and forced the account back open, the bank branch wouldn't stop it). I was told I am in the red for $1473. which has to be paid off in 12 months. I again explained the situation and she said she understood and had heard the same story from several people recently. She was very sympathetic but said in her dept. there wasn't anything she could do to reduce the fee's. She said after I made a couple of payments I need to go into the bank and talk to the branch manager...give her name and explain that only the branch can request the fee's be reduced or omitted. At that time, depending on what the manager does...they can reduce or elminate the fee's. At this point though I have to make at least 2 payments to keep my account from going to Chexsystems. She checked for me again while I was on the phone and said it had not been repported as yet and wouldn't be if I started payments. She also said the time frame is slow because they have to wait for everything to go through the system. For example my first payment to them isn't even due until 08/15. She also said every bank will handle this kind of thing differently..but usually after your account goes - like this it will be reprted within 60 days to Chexsystems.

Doesn't look like I have much choice..although I do plan on contacting the branch manager sooner than recommended. I thought I would just let everyone know what happened as there are so many of us in the same situation.

Morningstarr, that was nice of them to give you a call and to give you a chance to stay out of chexsystems. That will be great if you can get the fees taken care of. That would probably settle most of the balance right there! Good luck, and let us know what happens. Do you have to make a certain payment, or whatever you can afford?

Yeah, the same thing happened to me . . . Darn those stupid banks! I would keep at them, stressing the point that these charges were unauthorized. Also, if this is a national bank, there is another agency you can complain to. It's the Office of the Comptroller of Currency (OCC). It regulates all the national banks.

I have found that branch managers are like night and day. Some will help you because they care and others may only care about hte bottom line. You might try filing a complaint with the Office of the Controller of Currency or OCC. They are the watchdog for National Banks. I had good results when I did that. A lot depends on the circumstances leading up to the present situation. Was it fraud? The banks refusal to close your account early on? It is worth a try.

I have to pay it off in 12 payments so right now that would be $122.75 a month. It will be hard since I am also doing a debt management thing...and of course they can not go into that..I am going to try to contact the bank manager first if I don't get a good response then I will write the OCC. I will say I am glad though to get confirmation that I am not on Chex...I can go back to direct deposit at my new bank which is so much easier for me!!

thats good news. At least they are letting you pay it off,
My bank wanted the entire balance 1120.00 at one time or else they would report me to chex. Thank goodness for a good friend who loaned me the money, and saved my account(which i since closed and opened elsewhere)
He only wants to be paid back 50.00 a month. Good friends are golden

morningstarr, I'm so sorry that your bank is not helpful in this as much as they should be. However, I just wanted to tell you that it is up to the branch manager to reduce or reverse the bank fees. The corporate office helped me get the pdl debits reversed, but even they told me it was up to the branch manager to reverse fees. Kiss up to the branch manager! LOL! I hate to hear that you're responsible for all those fees. I just don't understand it. They were unauthorized debits. They were illegal transactions. At least try to get the branch manager to reverse the bank charges. If they understand that these were unauthorized charges and now you're having to pay to negative amount, maybe they will be willing to take off all the bank charges. Only the branch manager can do this. I'm so sorry you have to make payments. That is just crazy. At least you're not being reported to Chex, but I still think they should have done more. As they stated above, file a complaint. What's it going to hurt? Nothing. They already stuck you with paying all that money.

Oh I agree Cannr...I am going to go in and talk to the branch manager as soon as I get the papers from the LP office. I know she said I had to make at least 2 payments but I can't see why..LOL..and if talking to the manager doesn't work I will make the payments but I will also start filing complaint...and then maybe I will get a refund too!

morningstarr, that's the attitude! Think positive! Lord knows something good has got to happen! Just go kiss some branch manager butt and hopefully you'll get some or all of the fees taken off. There is no reason you should have to pay those fees. Good Lord, they're already making you pay for the stupid illegal pdl debits.
