I have 2 loans out...
1. with paydayone and they are working with me and I just sent them a counter payment plan explaining everything to them and hoping they have some humanity and will work with me and change the payment plan to something that is realistic so I have my fingers crossed!
2. with cashnetusa who has continued to debit my checking account even after ach was revoked and BOA will do nothing about it.........go figure!
Well I did what Shazzers suggested and I filed complaints with the texas AG, BBB and the FTC.
Now I am just waiting to find out whats going to happen next once cashnetusa gets the complaint from the BBB. I suppose it will get nasty but I am ready for them. They picked the wrong person to tick off.grrrrrrrrr
If anyone has any insight as to whats to come I would appreciate the heads up.
Shazzers a BIG thank you for your help
I will keep ya posted!!

well nothing new to post on the bbb but I did make one last trip to the main BOA branch and talked to the manager and behold the stars were aligned and he was able to put the hard freeze on my account and only deposits will go through....he also had me report the 5/8 transaction as fraud and got the negative balance taken off so one good thing happened today! woot woot
Still no reply back from paydayone with my counter payment plan still hoping for the best!
Good Morning, Seems I am talking to myself but whats new LOL
Good Morning,
Seems I am talking to myself but whats new LOL
Heres whats new...
BBB e-mailed me with my complaint number and cashnetUSA has 22 days to respond so I guess the waiting continues...
Waiting on papers from BOA to finish filing the complaint against cashnetUSA for debiting the account after they e-mailed me stating they understand I dont want them to debit my account.
Lastly...PaydayOne sent a reply back and accepted my counter payment plan and I will get to repay once a month which is more realistic....it will drag it out longer but at least my kids will get to eat soooooooo whooooohooooo!
Things are looking up!
Have a wonderful day everyone

YAY for you!! Persistence pays off for sure! I am so glad you are looking out for your best interest! I know it will work out for you eventually! I certainly hope the FTC will slap a big fine Cashnet breaking the law (Regulation E), there was absolutely no excuse for it! I swear these are desperate times, even the legit companies are saying and doing things I wouldn't have expected. I suppose some comapnies believe they are above the law, pluse Cashnet probably didn't foresee that you would follow through and file complaints against them. Good job, keep up the good work! :D

That's great WinterAriel412! It is good to hear good news....I have 5 illegal loans to take care of and start the fight when they don't get their payment at end of month....I'm scared but excited to get out of this...........Just dreading the calls they will probably make to everyone I know.....
Well I havent gotten any calls yet but cashnetusa thinks they go
Well I havent gotten any calls yet but cashnetusa thinks they got paid so they won't call until they get the complaints or when they try to debit the frozen account but I am to the point where I don't care call as much as you want I can call em back and bug them just as much.
Anyways has anyone had any luck with the BBB or FTC?? or is it just to get the complaint logged for future reference??
I guess the Texas AG is the best bet to see some action?
Anyone know??
BBB
I have used the BBB several times to get creditors off my back and have been successful each time. I just used the BBB for one of my many payday loans and they seem to be willing to work with me. The payday lender is willing to take my offer to pay back the principle on the loan. So far so good.

Kenkaye you just file complaint with them or what steps do you take with BBB?
BBB
If I feel that a ca is harassing me by calling my job or my home I file a complaint on the person. Especially if they are being rude to me. Even if they are not BBB associated the BBB will contact them for you. They will either send you a letter or contact you through your email address once they receive a response from the collection agency or whoever you are filing a complaint on.
you file a complaint with the bbb and they actually do something
you file a complaint with the bbb and they actually do something to help or just blow ya off? I figured I would get some lame letter they sent to everyone saying ty but we cant do anything blah blah LOL
BBB
No they do their job. They contact the companies and send you a reply from the company. I have done this maybe about at six times and there was only one time that a company did not respond. For the most part everything has worked in my favor. They actually try to help you but it is up to the CA to respond to the complaint that you file with the BBB. They give them a certain amout of days to respond and they get back to you one way or the other.
Newest Update
Well I am still waiting to hear back from the BBB and according to the e-mail I got CashnetUSA has until 6-2 to respond and according to the link they sent there has been no changes now I did log into BOA to check my account standing after I filed to have them reverse the charge....
Well they charged me 35.00 for the original charge then cashnet put thru 3 more times and they reversed them all but still charged me 35.00 for each with a grand total of -140.00
I don't understand how they can try and charge a service charge on an account that is frozen??
Now on to PaydayOne....1st payment is due on the 15th and then I will have 3 more payments until its payed off woot woot!

Cashnet is very tricky, when I was dealing with them I sent them several letters by email and certified mail revoking thier authorization and they still tried to do it. Luckily I work at the bank and when I saw the pending transactions I was able to get a block on it before it hit the account. Even after I put the freeze on my account I could still see where they tried to debit. I even called and yelled at a cashnet rep about it and he told me they had the right to do it since I owed them. I told them, "No you don't and if you continue to do it I will file a fraud case against you, I work at the bank and I know the rules." He kind of got quite and after that they didn't try it anymore. They actually accepted a monthly payment plan of $105 on my $750 balance.
debt
I FINALLY had to make a 'stop payment', on my account.......Biggest Cash was trying to debit my account every week, instead of every two weeks. It was getting annoying!! Finally they said that 'since they couldn't get payments from my account that I AUTOMATICALLY defaulted on the loan.' OMG!! That's not it at all!!..I told them. So......having trouble with them. They sure don't listen to the 'consumer', do they?
Winter have you started the complaint process with OCC against B
Winter have you started the complaint process with OCC against BOFA? Seems they don't repsond to anything other than OCC these days.
Okay just got home from work and thought I would post an update
Okay just got home from work and thought I would post an update....
Today was the 1st day since this all started after the debits were reversed and taken back from cashnetUSA that they called me at work and since I wasn't at work yet they left a message with a co-worker from someone names "Sarah with CNU" took me a while to figure out who the heck CNU was but it finally clicked.
Well I work in a pharmacy and it gets busy in the evening when I get there so I didn't get a chance to call them back.
Anyways here is my problem.......I revoked ACH and they still debited....I filed with BBB, AG, FTC and no word yet, I also demanded that all contact be written and they call I guess so theres nothing to trace?? I don't know so should I write them again stating that they are to only contact me by e-mail and USPS?
Don't get me wrong I want to pay them and I was going to put PaydayOne on hold to pay them off then they do the sneaky stuff so I feel its only right to work with paydayone 1st since they have been up front and changed the payment plan 3 times so it was affordable for me and at the time of the month that worked.
Any thoughts, suggestions or input would be appreciated cuz I am about ready to call them non stop ranting .......bug them before they get a chance to bug me.
Anyways thanx in advance for any thoughts/comments/suggestions.
Did you dispute it with your States Department of Finance? That
Did you dispute it with your States Department of Finance? That was the only way I got them to reverse a double debit.
So the bank reversed the debits?
I would also include your states DFI. Why is your account still open? You should have closed it by now so they don't have access to it.
My account is still opened because its BOA and if they closed it
My account is still opened because its BOA and if they closed it and an ACH hit the account it would reopen it....and yes the branch manager was up front about that so he put a freeze on the account while they "looked into it".
Up until Monday the account was still negative the original charge plus the service charge then the charge was returned after they got my paperwork and copies of the letters.
I really don't have any complaints with the bank......well after I finally found a manager who knew what he was doing.
He has been upfront about everything and even told me not to reopen another account at BOA until this is resolved even though I hadn't planned on it he was very helpful.
Its just what to do with CashnetUSA.......should I call them or should I keep everything is writing??
