payday loan harassing phone calls

Can they call 6 or 7 times a day and as many as 4 times within 14 minutes. They have threatened to garnish my wages. Can they do this without a court order?


Is it considered harassement to call that many times? I get calls I can't tell you how many times a day. They leave a message and all it says is PaydayFlash. I don't answer it because I know it's a pdl calling and I will NOT deal with them on the phone. I was just wondering if there was some kind of limit to the phone calls. They even call at 8am on a sunday. And since they are based out of California, I got one at 1015 pm. I get up at 430am so this woke me up.

Wow, that is DEFINATELY harassment. And calling you at 10:15pm is definately against the FDCPA--and you can nail them on this. Do you have the call on voicemail, anything recorded? Under the fdcpa, a creditor can only try to contact you between 8 am (sorry, that call on Sunday is legal :( ) and 9 pm your time. I don't care if they are based on the West Coast or Timbuktu, they violated your rights there.
You can also ask that they not contact you on the phone at home and or at work by writing them what's called a cease and desist letter. You can find templates on our site.
