Criminal charges, can they arrest me

Hi, new here and hope someone can help answer some questions.

I have a few Payday loans. I had to close my bank account due to fraudulent drafts made to my account--not anything to due with the Payday loans. Charges have been filed, my bank as well as the police are investigating. I have all the paperwork to prove this, as to why my account was closed.

I have been reading here and checked my state law. I live in Missouri and it says:

Missouri Payday Loan Laws
State Legal Status
Lending of payday loan is considered legal in the State of Missouri.

•Criminal Action - Prohibited (when check is retuned due to NSF)

My question, can they have me arrested for closing my account?


it says criminal action prohibited.also are these internet?if so they have to be licensed in your state to lend.a couple of questions.

names of the pdl's
amount borrowed from each
amount debited by each include all fees and rollovers
are these internet or storefront

we can help further if you could answer those questions,but a pdl whether internet or storefront can have you arrested for owing them or defaulting.

Actually the regs say that criminal action is prohibited when the check is returned due to NSF. There was a post last month that recapped a conversation with the Head of the MO DFI and he stated that a closed accounts is open for prosecution.

Now back to the OP's question. Since you have a police report, I would make copies and get intouch with each of your PDL companies to get information changed to the new account. The odds of the PDL's filing charges will be slim and none since this would not be good press. That option would be left for the individuals that have knowingly committed fraud againt the PDL.

My pdls are
PayDayOne, $500 borrowed nothing paid so far
CashNetUSA, $500.00 borrowed $125.00 paid so far.
Think Cash, $200.00 borrowed $280 paid so far.

I think all of these are legal from what I read here.

I copied the ach revoke letter from here and sent it this morning.

PDL Owner I just got off the phone with The Missouri Division of Fiance, a Mr. Joe Crider after I read your post. He said his best advice would be to close my account. He said that no charges would be filed if I closed my account due to the other fraudulent demand drafts because I have the right to protect myself. He told me to send the revoke ach agreement and told me under federal law that had to accept it. Then he said to call the pdls and work out a payment arrangement.

Joe Crider said there has only been 2 cases that he knows of that criminal charges where filed in the state of Missouri due to pdls and closing the account.

Gosh! I was scared out of my mind! My pdl payments are due on Aug 3rd. I will call each of them and try and work out a payment arrangement. Hope they will accept USPS money orders. I sure do not want to open another checking account after what has happened to me!!!

Does anyone know if PayDayOne, Cashnetusa, and think cash are easy to work with?
