i have an old delinquent account with Check Advance and they just slip there card in my door at home when im not home once every couple weeks....i was making them payments of $20 but we just cant swing paying all of these right now...and i am considering filing bankruptcy and the beginning of 2012 but does anyone know if having more than im supposed to have will change how my case is dealt with??

My suggestion is to call them (generally the corporate office is more cooperative) and try to work out a payoff arrangement. Tell them you cannot afford to pay as agreed and they will either have to work out an affordable payoff agreement with you or you will have to default on the loan and work with their collections department to settle it.

You can't go to jail for not paying a payday loan. The worst they can do is harrass you and then sue you. Even if they sue, if your only income is SSI, they don't have any leverage against you.
