Getting Started
Date: Sat, 05/19/2012 - 06:48
I've already contacted my bank to stop any future ACH debits and have opened a new account that I will start using ASAP. Finally, I've e-mailed letters to the lenders, will fax letters on Monday and will send hard copies on Monday as well BUT am unable to find an address for one.
EZ Payday Cash - e-mailed and have address
Green Trust - e-mailed and have address
PlainGreen - They set up as an installment but there is a note on their site that they operate under Texas PDL laws....any ideas if this is legit?
Integrity Pay day - e-mailed but can't locate an address
Under WA law if the PDL company is not licenced they are unable to collect on the debt. Am I reading that right?
Any payday loan obtained from a lender not licensed with the DFI, and not repaid to the lender may not be collected by lender and the lender may not pursue action in Washington State to collect the debt. See RCW 31.45.105
Thanks!!!
EZPayday - Their site itself mentions that they don't do busines
EZPayday - Their site itself mentions that they don't do business with people from Washington. Unlicensed and illegal.
Green Trust - Illegal tribal lender.
Plain Green - Illegal tribal lender.
Integrity - These guys are not actually the lender. They just collect information about applicants and sell them to actual payday lenders.
Yes, you read the law right, you don't need to pay illegal lenders anything other than the principal sum that you had borrowed. Anything paid over and above that amount must be refunded by the lender.
You might want to read this: http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html
Once you are done dealing with these lenders, you might want to file complaints against them with the FTC and the AG.
refunds
I've also sent e-mails to two of the lenders (Integrity and EZ Payday) asking for refunds. Does this ever happen? Also, can I expect to receive LOTS of phone calls once they stop receiving money?I've sent e-mails to Plain Green and Green Trust asking for payment plans - does this ever happen?Just trying to prepare myself for what's sure to come!
