Payday loans debacle leads to eviction notice today
Date: Tue, 12/13/2011 - 21:52
After last weeks complete drain of my account by the payday lenders fees and charges on my account the account was completely drained. after spending the day crying over what to do next, I sent the landlord a text message the next day telling him my account had been hacked and my direct deposit had been drained, that i get paid again on 22nd and would pay in full on that date. (i sent a text message because when i've talked to him on phone he has selective memory of what is said. also, i didn't tell him i had taken out payday loans just cause i'm so humiliated i got myself into this mess)
anyway, i didn't hear back till today when i got home to an eviction notice on my door stating i had till friday the 16th to pay in full. the funny thing is that the whole reason for the payday loans in the first place were due to a few paychecks that were less than i expected and so i took out the loans in order to not be behind on my rent.
do i have any options at this point? since i don't get paid till 22nd i can't hire a lawyer, but i also can't end up on street this weekend, i work the whole weekend. please please guide me what to do next :(

re: eviction notice
Hi,
I don't think the so. the letterhead has the building owner's name and address only, and i live in florida.

He has to go through the courts to evict you and it has to be for at least 30 days. You do not have to abide by his letter and no sheriff will honor it.
You can sue him if he locks you out of your apartment or remove your things without the proper papers being served to you.
follow-up questions
is that 30 behind payment before i can be served or 30 days from time he files? as of today i'm only behind by 14 days, but i want to make sure i have an appropriate answer for him.
also, since i can't pay on the till the 22nd and he's demanding payment on the 16th, how should i respond to his letter? and should it be in writing or by text (i don't wish to speak to him by phone since he has a habit of remembering only what he wants from our conversations?)
thank you again for all your help. you're all amazing! i should have come to you when i first started having financial problems
