Re: Getting Responses
I had a loan with Great Plains. I had overpaid them due to the fact that they were a illegal tribe. It took them a couple of weeks to contact me but they did stop debiting my account. I sent a follow up e mail requesting a pif letter and after 2 follow up letters the did give me a pif letter. Go on their website and see what it is saying.
I was wondering if you have heard anything from Net Credit I am trying to work with them and have not heard anything yetl
Good Luck
PDLs and revoke ACHC
Hello there, just wanted to share my experiece since I'm starting the battle too. I've sent all four lenders (Greatl plains, netcredit, mobiloans and cashcall) an email advising them their ACH access is revoked and they all have stopped and responded quickly. Mobiloan tried the "please contact us via phone to discuss this but I emailed again let them know I know it had to be in writing!) I am moving towards chapter 13 and cashcall went crazy when I was 1 day late and so I sent them a cease and desist letter explaining things. They stopped calling literally within the hour of faxing the letter. So far, so good. So this all makes me nervous, how quiet it has been but thought I would share my progress as well. I am in Wisconsin so here there isnt really such a thing as an "illegal loan", there are little resctrictions on PDLs so I was very limited on options. My other option was chapter 128, for those are in WI it is another great option to escape PDL hell!
All of that is utter BS. You
All of that is utter BS. You being a citizen of the United States are only subject to state and Federal laws and you are therefore not bound by the laws of St. Vincent. Moreover, 'Payday Loans' are not covered under GATS W/120 so that does not apply either. Just ask these nutjobs to go to take a dive off the nearest cliff.
Thank you for contacting us

Tell them to drop dead at this point - if they won't accept your offer that's it.

So far received 2 replies. The first is basically a "Please call us so we can discuss and help". I sent back an email reiterating that all communication will be by email. The 2nd was from Bestloans123.com. They basically said: "As noted in your loan Agreement, BestChoice123 is based in Nevis, not in the US. Because we are based in Nevis, we operate under the laws of St. Christopher and Nevis, and are not subject to U.S. laws regarding payday loans. As such, we are not required to have a license in your state. We are entitled to the monies and payments as you agreed upon in the loan Agreement. Please note, if you do not repay the loan as agreed, this loan will become a negative item in your credit file and will remain so indefinitely." I replied to that saying they are illegal and I was planning to report them. They replied again noting that I revoked authorization on my account and they are entitled to the monies... Today is report them all day...
