Ok so I have a few questions for anyone who will answer.... I need to know the best route for dealing with in-store payday loans. We have four out and have been doing this for 6 months at least.., we have more than paid in fees but it neverends. I know california laws states that there is only to be one loan per borrwer and that they souldn't be reoccuring. Do these places let you make a payment plan?? how the hell do you ever get out of this?
My boyfriend deferred on an internet loan and now there is a collection agency saying we owe 605.00 when he borrowed 300.00. by state law a think that the most they can collect on that is 315.oo??? anyone know?

I would file a complaint against the internet payday loan first. And you should contact each storefront and make payment arrangements that you can make. They may give you a hard time at first, but you must be firm and stand your ground. It is possible to end this cycle. Kscornell is a member here from CA and she can give you more info. on the state of CA. Which companies are you dealing with?

CashNetUsa is about the ONLY licensed ipdl out there. MTE is a joke in my book, they go by ameriloan, Ten Dollar Payday and a few others I can't remember right now. DEFINATELY file a complaint with your AG's office and the office which oversees these companies. On Sept. 8, 2006 CA took action against unlicensed ipdls and has a list (which I'm sure has grown) ordering unlicensed ipdls to cease and desist operating and loaning to CA consumers. Definately get a complaint in against MTE and Quickest Cash.com. I am certain MTE isn't licensed and you will probably find that Quickest isn't either. You need to contact the storefronts and make them your priority in paying back with a payment arrangement you can afford.

Also, it may be in your best interest to close this account and open a new one to gain back control. And open a new account at a new bank. These ipdls go by so many different names it is nearly impossible to block them from debiting your account, they will just go in and do it under another name.

i already closed the account thats why they are trying collections.... the in store ones are the ones that are getting harder to pay...I havent asked about re-payments plans but i'm going to. By law dont they have to let you make some sort of arrangement to pay them off, im sure they can't just harrass you and your references and then send you to colletions???

Check-n-go is a royal pain, but they will let you make payment arrangements thru collections. I haven't dealt with the other ones on your list, but I can tell you that they can't arrest you for defaulting, so if you're unlucky to get a call from Bass, tell them to stuff it. What they could do is send you to arbitration if you're dealing with a storefront. I would also cancel any voluntary wage assignments you may have signed to take these loans. They're not legal in Calif anyway, but not everyone knows that. They can't garnish unless they get a judgement in court.
