Well --- I had defaulted on a loan with magnum Cash Advance out of Delaware. The total of my loans was $971.83 --- I had paid $741.48 to date. So morally I should only owe $230.35 correct?

I live in the state of Ohio and have already checked all licensing and have found they are not legal in Ohio.

If I understand it by Ohio laws ---- they are not permitted to loan $5,000 or less to anybody in the state of Ohio if they are not licensed and also that if they do lend they have no right to collect on those monies, fees, etc.

Not they are sending me emails demading payment of $585.00 or they will report me to teletrak and major credit bureaus and send me to a collection agency.

Has anybody ever dealt with them?


They aren't licensed in Ohio, therefore they have NO legal ground to stand on. You really should file a complaint with the Ohio Attorney General, and the FTC (in my signature). I would simply send them a copy of Ohio Payday Lending laws, tell them IF they do report you to any of the agencies they listed, you will simply dispute it, then it will be upon them to provide proof the information they are reporting is correct. I don't suspect it will go any further than threats. You can dispute any negative remarks on your reports however. By the way, the only thing teletrak is good for is keeping you from getting another payday loan, in my opinion, who cares. :D

I also have a PDL with them. When I sent the C & D letter to them they actually e-mailed back and stated they would not debit my account anymore and would not contact my employer or references.

I have since them sent them a letter stating my state laws showing they are operating illegally in my state and they owe me $44.07 at this point. I have not heard back yet, but would be happy to just leave it as PIF at this point.

Thanks for the info. Did they give you an ultimatum about sending you to a collection agency and reporting you to teletrak?

I will send the C&D letter. I believe that I still owe them $230.00 morally. But by reading the Ohio laws --- they can't collect on it legally.

I want to settle it --- but of course I don't have $230 in my pocket right at the moment either!

Sorry, I was the guest that responded, forgot to login.

I had already spoke to my credit union and placed a hard block on the account before sending the C & D letter to them.

I called the credit union after to see if the block was enough or if I should close the account. They assured me they would not let anything go through, I guess I will find out Friday when I get paid.

No ultimatums about payment or collection agencies. Legally I don't owe them anything, they owe me $44.00 at this point. I sent the letter on Monday stating they had 5 days to respond with a CC to my state attorney general. Now I wait and see.

I just wanted to update and let you know I received an e-mail from Magnum Cash Advance today stating the account is paid in full. They would not credit me the $44.07 I overpaid but I can live with that instead of paying them an additional $922.47 they originally wanted to consider the account paid in full.
