i am one of those with a western sky loan. i stopped payment and wrote a letter to them about their illegal i have not heard back from them but i did hear from our minnesota department of commerce. they say the cheyenne river sioux tribe is federally reecognized indian tribe. neither the state of minnesota or department of commerce has jurisdiction to intervene on my behalf because the loan was made by a federally recognized tribe. as a soverign nation they retain immunity from federal and state laws..what does this mean and where do i stand?.


Western Sky is not owned by the Cheyenne River Sioux Tribe......they are owned by a single member of the tribe. Western Sky is not a tribal entity but is, in fact, a South Dakota chartered LLC. You can pull up their organization documents online. Unfortunately, people read the clause in the contract documents and don't bother to actually look into it....that's what they are banking on. The loan is only enforceable on the Cheyenne River reservation.

today from the Minnesota Department of Commerce. The previous poster is DEAD on right about Western Sky Financial LLC being one person with an LLC that is registered in South Dakota. I was able to find all of their documents on the Secretary of State's website. I am going to print them out and send them to Commerce. All I am out is a little bit of time and some postage, so what can it hurt? (Now that I can actually afford postage now!)

Make sure you file a complaint against Western Sky with the South Dakota AG's office. They will respond. Western Sky is only legally licensed in South Dakota (as you found out by looking for the organization documents), however, they do not offer their loans in SD.....probably because it would be usurious and illegal....duh. South Dakota's AG's office has been helpful. The complaint can be filed online.
