Payday Loan Collection Agencies Harrassing Me
Date: Mon, 08/24/2009 - 21:50
So it's been a while since I've posted. Things were pretty quiet for a while as far harassing phone calls, etc. Then recently the calls started again, also things are starting to show up on my credit report.
A while ago around October 2008 I wrote each one of these companies letter's willing to pay the difference between original amount borrowed and what I had payed none of these actually responded. The only ones that did respond were the ones that Marked Paid in Full. I also asked for refunds from the companies I had overpaid.
Below is a recap of where things stand (I live in Massachusetts)
Companies which agreed to Mark Paid in Full:
Company / Current Balance / Originally Borrowed / Paid So Far
Webpayday / 0.00 / 800.00 / 1400.00
USfastcash / 0.00 / 450.00 / 1190.00
Oneclickcash / 0.00 / 400.00/ 1180.00
Companies I had overpaid
Company / Current Balance / Originally Borrowed / Paid So Far
PaydayMax / 706.15 / 500.00 / 505.40
Paychecktoday / 195.00 / 300.00 / 735.00
CashAdvanceNetwork / 520.00 / 400.00 / 480.00
Companies I owe some balance, not what they say I owe
Company / Current Balance / Originally Borrowed / Paid So Far
Payday Loan Yes / 455.00 / 350.00 / 210.00
InstantcashUSA / 675.00 / 400.00 / 120.00
DiscountAdvances / 698.25 / 420.00 / 141.75
So I haven't heard a peep from the companies I've overpaid, with the exception of the "Paid in Full" ones. But now I'm starting to get harassed by the one's that I owe some sort of balance; below is a summary.
-Payday Loan Yes has sent a few random emails and a couple of phone calls here and there.
-I've received letters from Professional Debt Mediation collecting for Discount Advances and the worst of all Prof. Debt Mediation is now showing up on my credit report.
-I've received letters and phone calls from both ACA recovery and the law office of Norman Kalina collecting for Instant Cash USA
-I've been getting several phone calls a day from the Cambece law office, from some guy saying I have a court date for writing bad checks and he wants to see me in person so he can serve me my papers and that he will continue to contact me @ home and work.
-Also Midland Credit Management is showing up on my credit report as well for a balance of $389.00, I have no idea for what
I really want to put this all behind me, I feel like I'm so close. I am very willing to pay the difference from what I originally borrowed and what I paid so far to these companies but they don't want to respond...they just keep harassing.
Any help on how to take the next step would really be appreciated.
Thanks,
Treenor

Dispute it on your credit report, all you need to do is send a copy of the MA payday lender laws to the CRA and state you want them removed on the grounds those loans were not legal binding contracts. Unless you want to go into a detailed letter about who you owe and who you don't that's all they will need to remove them from your credit report.

The FDCPA requires that debt collectors send consumers a written notice that includes, among other things, the amount of the debt, the name of the creditor to whom the debt is owed, and a statement that, if within thirty days of receiving the notice the consumer disputes the debt in writing, the collector will obtain verification of the debt and mail it to the consumer. The FDCPA also provides that, if a consumer does submit a dispute in writing, the collector must cease collection efforts until it has provided verification of the debt. Many consumers told us that collectors ignored their written disputes, sent no verification, and continued their collection efforts. Other consumers told us that some collectors who did provide them with verification continued to contact them about the debts between the date the consumers submitted their dispute and the date the collectors provided the verification, a practice that also violates the FDCPA. |

SHAZZERS..........have a question. You say they are not "legally binding contracts." But,.......if we sign our name on the 'dotted line', doesn't that make it legal (lack of a better word) Also.........................alot of the PDL's ARE illegal, true,..so, how can a CA try to collect on an illegal account? I hope I din't confuse you TOO much. LOL
good question...was wondering the same thing about how they can
