payday loan dilemmas!!!

Hello everyone! Well, my direct deposit transition went smoothly today, and I was able to close my old checking account this morning, narrowly avoiding 5 nsf fees from my storefront pdl's. However, I know I can expect a deluge of collection calls when they get the checks back. But at least I can breathe a little easier now! The only question I have now, is what can happen if I can't pay them, nor afford to file bankruptcy?! My only income is social security disability so I know it's protected. But seriously, I just don't trust these companies!!! Another comforting thought, though, is that I also know criminal action is prohibited in Kentucky! On one last note everyone...PLEASE BE SURE TO VOTE TOMORROW!!! Thanks!!!!


I think I will make an appt. today to see an attorney about filing bankruptcy. I don't know that I will be able to afford it, but the initial consultation is sometimes complimentary. I like the idea of sending the storefront pdl's an email, too. It's not as confrontational as phone calls or going into the stores, yet still acknowledges and deals with the issue. It's amazing to me how much good advice and ideas that are shared on this website! Thanks everyone!!!

Hello everyone!!! Well, the news isn't as good as I'd hoped for, but it's better than it could've been!!! I did see an attorney today about filing bankruptcy, but the cost was prohibitive, and he was indeed the most reasonably priced one in town! However, during the 30 minute consultation, he did indeed tell me I was "judgement proof", and that the prosecutor, da, and county attorney are well aware that there is NO CRIMINAL ACTION that can be taken! And I told him the whole story, too. About the 5 pdl's, the closing of the bank account, everything. He didn't say directly, of course, but I got the distinct impression that pdl's are not very well liked in this neck of the woods!! And of course, the phone calls have started already when I didn't show up yesterday to pick up the checks!! One of them even called my mom's house!!! But as we all know, this type of behavior is a given, coming from them!! Right???!!!

The mentality of some of the pdl's employees never ceases to amaze me! Did they think I didn't know it was a collection call? Simply because they used their cell phone to call?! I just decided to go ahead and answer it, to at least "break the ice", and let them know I can't pay them, that's all!! Well, it's one down, two to go!! This lady said that until they get a case # for my bankruptcy(which I can't afford to file), that I'm still responsible for them. I know that, but do they know if you can't pay...you can't pay? Tell me, who of us in this forum would CHOOSE to do it this way?! Who of us wouldn't pay if we COULD???!!!
