Name Removed for you protection - Goudah,

Hi Everyone,

I got this letter today from CPD. They are theatening to take me to court which is laughable since mycashnow and discountadvances.com are overseas and not licensed to lend in the State of AZ. A judge would just laugh at them and dismiss the case. Anyone else gotten this before...???

I am thinking about obtainign an attorney and have him write a letter to all these illegal payday loan places that their debts are void. Just want to know what it could cost to do this...

I would just respond back to them like this:

Please be advised that i am considering obtaining an attorney to sue your

**** in small claims court. You are hereby notified that this debt is not legal, not legally binding, void, and uncollectible, as you are not licensed to lend in arizona. I am ready to take any legal steps that are deemed necessary and appropriate. Please take into consideration that i will make no more attempts to clear this matter up without involving the state attorney generals office as i have no choice but to conclude you are not willing to clear up this matter willingly. I regret having to take this action but feel that your illegal loan sharking has left me no alternative. If you want to avoid further action, mark my loan paid in full. Do not attempt to collect on this loan. Do not furnish any negative remarks to any consumer reporting agency. I must require that proof of this is sent to me immediatly. Please note that i will request possible service in order to take whatever steps are legally available to me in order to protect my interests. Your prompt response will only benefit you. This is my last attempt to help your company to resolve this before you get your ass handed to you by a judge for being an illegal loan shark.

***Please do not edit my posts and put my own words in quotes. And I was yelling, that is why it was all in caps. - Goudah

Hey I just got a letter like that too. I tried to pay them but I am just the wife they have to speak to my husband and he is never home. I denied the charges at the bank because I did not know who CPD is and the charges were taken out in two different installments and they never did that before so I am so behind you. In fact I am the one who did all the work to get him the loan.

I received another threat letter too:Quote:

I feel we have been more than reasonable with helping you clear this matter voluntarily. However, we have not received your funds so we will take other avenues available to us in order to protect our interest in this matter. Your account will now be forwarded over for outside representation of this legally binding debt. If you intend to clear this and avoid additional fees and possible request for judgment being issued against you for the repayment of this loan, please call our office immediately at 1-866-645-1661. Please be prepared to wire in your extension fees that are past due or give me an exact date in which funds will be available. If we initiate action, you will be responsible for all additional collection costs incurred.

We suggest Western Union Quick-Collect!

You need to go to Western Union and get the BLUE QUICK COLLECT FORM (or go to www.westernunion.com and choose the quick collection option)

1. COMPANY NAME: CREDIT PROTECTION DEPOT
2. CODE CITY: OFFER (ONE WORD NO SPACES).
3. STATE: NEVADA
4. ACCOUNT #: Your Social Security Number
5. The reference # is Your Telephone Number

You can also use your debit card or various charge cards at www.westernunion.com

OR you can go to Moneygram and get the BLUE EXPRESSPAYMENT FORM
1. The Company name is: CPD-OFFER
2. The Receive Code is: 4243
3. The City is: Las Vegas
4. The State is: Nevada
5. The Account Number is: 1430703366

If you are unable to the pay $562.53 for the entire balance on the loan as of today's date January 22nd 2008, then we must require a minimum payment of $187.51 to place the account on legal hold.

If this account is referred for further review and action to our outside firm for additional collection efforts, it will commence activity on the account to be done to the fullest extent of the law in order to protect our interest in this matter. At that point you will be responsible for all additional fees associated with costs involved for the collection of this debt.

Your immediate attention is required to prevent the other action mentioned above to being initiated.

Sincerely,

Credit Protection Depot
