Response from DJR to Revoke ACH
Date: Wed, 10/28/2009 - 14:22
I recently posted regarding three payday loans I have. They are all internet and I am in Florida. I received wonderful advice and directions on what to do. My loans are with StarCashProcessing, DJR Group, and Midland Funding LLC. I sent out the letter to Revoke ACH etc today and asked for a physical address to mail the remaining amount owed on the principal.
I just received this response back.. i'm not sure what to do with this..any help is so much appreciated.. they pretty much ignored my letter:( My bank account was closed last week .. payment would be due to come out either Friday or Monday so I have a bad feeling it is going to re-open my account.
Here is the email from DJR Group

The lender has received your complaint and has reviewed it. The laws that you are talking about refer to “store-front†pay day loan companies and not internet based companies, such as DJR Group LLC. You clearly knew the terms of the loan when you took out your first one, paid off your loan then applied for a second loan. The lender is not able to stop debits on your account, and no further action will be taken. Would you like to set up a pay down or pay off at this time?

Paul is right that is PDL jargon!!!! I would go to the bank and make sure the account is in the closing process and frozen!!!! You need to make it very clear to them that no debits of any kind are allowed through.
I never heard of an account being reopened by an attempted ACH.
I never heard of an account being reopened by an attempted ACH. You might want to advise the bank, that the accountis closed, a PDL may try a ACH. When I closed my account the payment was returned "account closed" in the ACH system. So in a nut shell, keep your bank in the loop.

Thank you. I read somewhere that a bank can reopen an account if an ACH goes through within 30 days I may have misunderstood.
Do you think since I sent the letter to Revoke ACH etc..I should just not respond from this point forward? Or should I respond to their response below.

Thank you all for your responses. This forum is a lifesaver. Does anyone have any suggestions on if I should reply back to DJRGROUP? I sent them the letter to revoke ACH etc and this was there response. I'm not sure if I should ignore it or reply.

I wanted to THANK YOU all for your replies and help with my payday loan trap. I replied to DJR as you stated above and I did also state that I would pay the principal owed because this was a second loan I took out with them and no rollovers yet. I felt it would be easier this way. After sending the same response back and forth the agree to allow me to make payment on just the principal owed by the 6th and if so they will mark my account paid in full. They even sent it in writing to be signed. THANK YOU!! Two more to go.

I know some people don't like doing this but considered using a pre-paid Visa/Master card. Also, look at the links in my signature, find the one, "Federal rules for AChs". it tells you about your rights in stopping an ACH. I put a "stop payment/ACH" for a PDL, which costs $30 and only last 6 months. Anyway, although there is a stop payment (ACH) for a creditor,my bank tellsme that all they have to do is use another name, dollar value and or accounting string. My stop payment is for GFSIL for $68, if they can their name or dollar amount they can withdraw money from my account and then I would have to request a new stop payment with the new information. I hope I made sense but please talk with your bank, every bank has different rules and fees.
