Drowning in Payday loans in Indiana

Can anyone give me any advice?


I am in Indiana and I have multiple loans out.

I have paid the fees on several of these on every paycheck and it never impacted my principle. Then some of them started coming down but I could not afford to continue so I closed my account.

There are no internet based payday loans licensed in Indiana. If you want to verify that, just call Indiana Dept. Of Financial Institutions, they are happy to answer your questions. Also, make sure you file complaints with the State Attorney General.

What state do you live in? What are the names of the pdl companies? How much did you borrow from them? Are your lenders licensed in your state? Give more details.

OK, I got my bank statements and did my research and here is what I found.

Dollar Premier
Borrowed $500, amount deducted $918.75 an over payment of $418.75

Mambo Cash
Borrowed $500, amount deducted $540 leaving me owing $60

One Click Cash
Borrowed $500, amount deducted $1,310 an over payment of $810.00

US Fast Cash
Borrowed $500, amount deducted $300, leaving me owing $200

Payday Mobility
Borrowed $400, amount deducted $120, leaving me owing $280

Alpine Group
Borrowed $300, I have made no payments at this time

I got a reply from mambo and this is what they said.

Dear Dawn,

As per the terms of the loan agreement dated 11/13/2012, you agreed to
the terms and conditions of a loan with our company.

Pursuant to the laws of San Jose, Costa Rica, where our company is
incorporated, the loan is enforceable and legally binding.

We are not required to comply with the laws of your State.

In addition to the executed loan agreement dated, 11/13/2012, you spoke
to one of our customer service representatives who explicitly stated the
terms of the agreement and you verbally acknowledged the terms.

As always, our primary goal is to satisfy our customers.

While we are not legally bound to do so, we are willing to work towards a
resolution of this matter outside the scope of our legal agreement.

As such, we are willing to forgo a portion of the finance fees that we
are otherwise entitled to.

Additionally, we are willing accept payment of the outstanding principal
plus $100 in interest payments to settle your account.

By coming to resolution on your account, we are aware that your account
will be in good standing and you will continue to benefit from consumer
loans in the future.

I have heard back from a couple of the PDL companies and most are wanting to come to an agreement. However, the two companies that owe me a refund are still stating that they are legal and will not be issuing me a refund and still want me to pay them more money. I have filed the complaints via the Attorney Generals Office and I attempted to contact my HR dept.

Borrowed $500, amount deducted $540 leaving me owing $60" you don't owe them, they owe you a refund of $40.00 - So I would resend them to that effect. Also stating that you could care less if you will continue to benefit from consumer loans in the future. Since you will not be taking out further loans from them since they are illegal and unlicensed in the state that you live in. That you are demanding a PIF on your account and a refund. That they need to apply all payments already taken out to the principal balance and be done.

Really now it is just a waiting game - glad it looks like you are all set though.. I would come up with a plan that you can live with to pay the ones off that you still owe principal to.. remember the ball is in your court and you want them to agree via email that they are accepting your terms before you send them any more payments of any type.. and then I would stick to prepaid card with only the amount they are allowed to debit on it or better yet send them money orders via mail.. to keep good records!

If you can not find them there anywhere on the Indiana Department of Financial Institutions website then they are not licensed to lend in Indiana... Hence Illegal..

How much did you originally borrow? That is the principal of the loan! You need to figure out what you paid so that we can determine if you still owe them anything on the principal or if they might owe you refunds. Since they are illegal due to not being licensed to lend in your state you are only morally obligated to pay back what originally borrowed minus anything paid to them already.. You still need to send them something in writing revoking ACH authorization and wage assignment. If you follow the link I sent you then it will show you how to write the emails or letters - if you mail them you will want to send CMRRR - certified mail return receipt requested.

When did you stop paying them all - when did you officially close down your account? I understand that you closed down your account but you must have some idea of how much and how often you were paying on these loans!

I would give copies to your HR department if they need some of these companies will try back door approaches to try to get money even out of your pay directly. I would recommend telling your HR department that your were a victim of fraud.

I have emailed all the PDL companies with my totals and such. I had already closed the account they accessed so that is no longer a problem and I can call my HR Dept on Monday and tell them I have been a victim of fraud to keep them from touching my wages. What should I do next just wait?

Lenders have to be licensed in Indiana - go here to see if any are: Regulator - Indiana Department of Financial Institutions

I am sure they should have a website you can look up on to see if any of these are licensed to lend in Indiana. Are they all internet? Follow this link on how to deal with the unlicensed lenders. http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html - Your account is already closed, so good first step.. You need to get your ACH authorizations and Wage assignments revoked right away.

I see how much borrowed from each - how much paid to each so we can determine if you owe any principal back to them - which is all you are morally obligated to repay if they are illegal due to not being licensed in your state.

Well I closed the account that has the information on it about what I have already paid in. The amounts above are what they told me I owed to pay off my loans. These are all internet loans I was paying about 700.00 a paycheck for just their fees so I do not know how much if any they have applied to my principle.

I looked at the link but I was not able to find any of my PDL's on there. Is this because they were internet based? Am I still able to tell them it's not legal? I have already closed my account do I still need to speak to my HR dept?

What have you gotten back from the two that you have overpaid? Remember that the ones that are working with the payment arrange has to work for you...and you will want to send them money orders only.. no access to your account in any way.. Why are you having problems contacting your HR department, you may be able to also just notify someone in payroll...

I do not know how much I have paid them... And how do I get the ACH and Wage Assignments revoked? I live in Evansville which is 3 hrs from Indianapolis.

Are these all internet loans. You don't have to drive to Indianapolis search online for the website for the Indiana Department of Financial Institutions and they should have a link to see who is licensed to lend in the state.. You follow the link that I sent you above and follow the steps to revoke ACH authorization and wage assignments via email or letter to the lenders. What do you mean you don't know how much you have paid them? Look at your bank account and total it up! Are the amounts from above what you borrowed or what you think you owe as balance? What we want to look at is how much originally borrowed - minus any payments already made to them - if they are unlicensed to lend in Indiana then you only owe the difference and some may need to send you a refund.
