I need some guidance here!

I received a call from East Side Lenders collections which I believe was Capital assests stating they were giving a courtesy call to let me know that they will be filing a fraudulent check case in the courts.

I do recall searching around and filling osmething out in maybe the summer of '09 and then receiving like a million e-mails related to payday loans.

I did close down my prior bank account back in November of 2009 because of multiple withdrawals coming out of my account. I researched then and sent to letters to all that were hitting my bank account.

I had asked if any payments were made on this and she said the payments they received all went towards the interest only and nothing on the balance at all.

Can they take me to court for fraudulent check charges for this? They want $1290 and if it goes to court it will cost another $1100.

What do I do from here? Do I ask for something in writing to show proof of debt? They claim they sent something but I never received it but I have moved since then.

I am just confused as to what to do next and where to go from here and should I allow it to go to court???

The CA's were calling you bout PDL's..is that what I'm understanding? First of all NO PDL's are legal in the state of PA. That's what helped me get a few of them off my back!! If you have CA's calling you about PDL's (in the state of PA), I would just hang up on them. I actually had CA's, on my CR, about PDL's. I 'disputed' them and they actually came off my credit because the PDL's were illegal in the first place. Don't give the CA's any info on you.

I'm also being harrassed by the "Capital Litigation Group" over an Eastside Loan from last summer. I'm also in PA. I told them that they can serve me if they want to. I don't think they're legit - they use the same script as the others do, even saying good luck at the end of their voice mail.

I reported them to the PA Attorney General, filed an IC3, and contacted the PA Dept of Banking.

The guy at Capital told me their not a collection agency but purchased the debt for the sole purpose of filing charges against me for a bad check (ACH) and breach of contract. However, I could settle over the phone. Of course I did not. I paid the principal of this loan and since Payday Loans are prohibited in PA, I don't feel they can really do anything.

If I hear from them again, I'll post here. Please do the same if you hear from them. Sounds like the same people. Phone number of 1-888-479-7876? They say they're in North Carolina.

LOL....I figured it was an idle threat because if the claim is valid, they should have all the information. LOL I can't believe he asked you for directions. LOL
I forgot to add he also at the end said "he wished me the best of luck" I had seen that same comment was made to other people that had posted.
