I am having a hard time getting anyone to respond to my cease and desist letter - I can not locate them either under secretary of state office etc. I did call them and was given the Rizzo Holdings as their corporate headquarters. If anyone has had any success reaching them please share whatever information you have. Thank you.

i do not think it is right for them to call your boss or references.. most original creditors honor this and if you tell them not to call at work, most payday loans even will stop.
is this company legal for you? ones who are not legal usually do not care and break the most rules..

As for sending c & d to the original creditor, you can try but sometimes they tend to default you when you do this.. i found this on a former post, if it helps:

"The Fair Debt Collection Practices Act applies to the collections agency and attorneys who collect two or more debts per year and does notto the original creditor."

No....ones I will be fighting are eastside (paid 1300 on a 1000 loan in refi fees I'm in Texas), GFS (GFSIL) overpaid GOD KNOWS HOW MUCH on a 374 loan - still going through bank statements. Ameriloan, PDL Loan Center and VCF Inc. I'm in Texas and only legal loan I can figure out is CashnetUSA which I am going to contact to make payment plan. PDL, VCF and Ameriloan I have paid off loans which they owe me $ for but owe balance on "new loans" so I'm going to pay balance on "new" loans ONLY and hit them up for overpayment to refund me on what I overpaid on other loans. I think that is prob. wisest, huh? I can manage this as long as they don't bother my work...# I gave them is my extension but they know where I work and afraid they'll contact my boss or HR. I work in VERY professional environment and I don't even want to think about what would happen if they contact my boss or HR....

they are illegal so you are entitled to get money back - anything you paid over the amount borrowed. The must honor your cease and desist letter. They can not under any circumstamces call your work, references etc. They are illegal. I have been successful with loanpoint a/k/a GRC and sign my loan a/k/a National Loan Service in getting refunds. If anyone needs the contact info to send a cease and desist let me know. Eastside hides themselves well, I cannot seem to uncover them. Any info anyone has please post.

Okay.....I just got nasty call from Valerie with eastside then this email.....
East Side Lenders is responding to your correspondence regarding the above-captioned account.

East Side Lenders, which is located in Delaware, is licensed by the State of Delaware to make small loans. All such loans are approved and funded in Delaware, with repayment to be made in Delaware. The East Side Lenders loan agreement and website contain all disclosures required by Delaware and federal law and make it clear that all transactions are governed by Delaware law. On the advice of counsel, East Side Lenders maintains that the choice of Delaware law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Delaware. The loan agreement is legal and enforceable. In responding to your correspondence, East Side Lenders notes and reserves all available legal and equitable objections to the points you have raised.

East Side Lenders provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. East Side Lenders will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so.

Should you have any further questions regarding this matter, if you wish to speak about payment arrangements, please contact us at (800) 689-5603.

Sincerely,

Customer Service

East Side Lenders

they are not legal - I have not found them licensed anywhere - they are just trying to scare. Be sure you closed your account because they will continue to take the fees etc.

Thanks for the info chroma601! I am wondering if this is common..........I had 6 and 2 I've worked with and we are on the same page (knock on wood)! 4 I haven't heard much from...Ameriloan, VC Funding, PDL Loan Center and GFs/GFSIL. I've sent them the letters, BBB compliants, FTC complaints, AG compliants...Only Ameriloan has responded to BBB and I countered their response. Wondering how it will all play out? I guess I'll just keep emailing / faxing every week to show I'm not giving up?

Okay well guys don't be disappointed with me....I'm happy. I just got GFS to agree to settlement of 100.00 to close and consider PIF.....I will send via Money gram. They really owed me $ but to have this off my chest and not have to worry about this one calling my relatives or employers....I'll just settle it for that.

I know..........I know........but if they don't call me back with Money gram details they get NOTHING........they were pushing for ACH and I stood my ground and said no...............and I gave them date on my terms..........In about 3 weeks they'll get it. Again, to not have to worry about collections, references being called, harassment on cell, work........I'll just part with it and move on. It is better than $400 which I thought they'd push for. I have mail from AG today waiting for me when I get home but I have a feelling it is just written confirmation of complaints I filed 2 weeks ago.

Can anyone confirm whether or not they are licensed to do business in Delaware? I cannot find anything on them, but one poster said they were legal.

I need this info ASAP because I will be fighting them. Thanks.
