Hello it's me again ok I got a call from this number 1-816-423-8000 apparently it is a collection agency for Everest Cash Advance, I spoke to the man that called and said I still owed $179 on the debt the loan was for $400, I asked him for a validation letter he told me that they don't send out that and that they are just there to collect on the debt, so he was getting furious so I was transferred to a lady and I asked her the samething and she pretty much said that I was crazy and that I have to go by there law and not Illinois which thats what state I live in and then she goes to threaten me with she will be contacting my employer with a wage garnishment, (I am no longer employed) and hung up on me.. So I'm in the process of send a complaint to my Ag but I don't have a address that they would not provide for me I do know it's a PDM company so if someone could please help me I would be very greatful to you... It is Professesional Debt Management.. And the number they called me from was 1-816-423-8000.. But the number that was left was 1-816-581-2442 and 1-816-581-4396... So after going over my bank records I have paid them $456.00 on a $400 loan and they are saying I still owe $179.00..

Ok I'm back with some more help, I finally heard from Direct Cash Express thru a certified letter, they are wanting me to pay $176 and call it even saying my account will be paid in full well my problem is I don't have the $176 plus like I've said before in one of my post I have paid them I believe over $900 on a $600 loan, so how should I reply back to them I got this letter from them due to me filing a complaint with the BBB!! And my other problem is with Extra Funds.com they just sent me an email wanting me to work something out with them to pay what they say I owe which was not stated, I've paid $90 on a $400 loan and they did try to settle for $300 and would not send me anything what so ever I just really need advice on how to handle these thanks, Amy

cash direct express sent a certified letter.wow!well that doesn't change a thing as they owe you.if you haven't file an AG complaint against them do so.if you have file a follow-up.bottomline they are illegal and owe you.not the other way around.as far as extra funds goes.see if they will accept the 300.00 via prepaid debit.if not then too bad for them.if they want new bank info or have you moneygram then no deal.

CDE sent me a certified letter as well as i have previously disputed them as they were illegal and I have overpaid. They wanted me to pay more to settle the account and they will mark paid in full. I responsded again, how much i paid and overpaid and they were not getting anything further from me. They did send me another certified letter back stating my account was marked paid in full. Don't back down! if you paid the legal amount, don't pay anymore! I never did get the refund and will not hold my breathe. I know better now. No More Pay day Loans.. whatever the issue is... I will now wait till my next paycheck!

Yes I have way over paid them I will have to respond back with all that info to CDE, but now this extrafunds one they just will not budge with any info what so ever why will they not send me a debt validation letter they told me they don't do that, I'm about ready to loose it with these people, they keep telling me that they are legal and able to loan in my state (Illinois)and I need to pay or collections will continue this is all I hear from them everytime I ask for anything!!!

Yes I got an email today from extrafunds stating that my validation is my loan documents that was emailed to me and also stated they don't have nor need a license to loan because they are Indian reservations I'm just in awe, someone please explain this to me I thought all payday loan co should have a license!!!

I just defaulted with extrafunds and they think I paid them $150 on April 1st, but it will bounce back in a day or so. I sent them a letter the other day saying that there loan was illegal and here's the response I got from them:

Hey Customer,


When you completed this application and signed your documents online you were given the opportunity to review your loan documents in full where it clearly states in red on the very first page that We are a Native American owned company operating on the Rocky Boy Indian Reservation and pursuant to the Laws of the Tribe and the Indian Commerce Clause of the United States Constitution. This states that we are not individually licensed through each and every state, that we operate through a sovereign nation. By going online to fill out this agreement, you have left the jurisdiction of your individual state and have entered into an agreement through our reservation and are then bound to any and all laws stated in that agreement.

Attached is a copy of those same loan documents for your record that clearly state all of our licensing and your agreement to this loan and any fees that may incur if you do not pay in full on your first pay-date. Near the bottom of the first page it also states that you are agreeing to go through our licensing, that there is an "exclusion of any state court or regulatory body."

So far you have paid $150 with $0 going towards the original principal balance. If you would like to pay off your loan in full you may do so at any time. The total pay-off balance is $650 (unless you pay by tomorrow 04/05 when you are allowed to pay just the principal balance of $500.) Your next payment is scheduled for $150 on 04/15 unless you let us know in advance to add anything or pay off the full balance.

I WROTE THEM BACK THIS: Dear Ms. Miller,

Your explanation is laughable. To think that a native american law is enforceable over a state's law or even federal law is ridiculous....especially in the case of a payday loan. I follow New York state law and that is what I am obligated to follow. I don't care about an indian commerce clause. That's a joke.
You would be thrown out of court and considered a joke if you tried to recover these illegal funds thru legal means. My father is a lawyer and I know several lawyers and a judge. If you sell my information to a third party collector, Extrafunds will be reported to the Attorney General of New York.

I would like a paid in full letter and my account closed ASAP!

THEY WROTE BACK THIS:
I'd be more than happy to send you a paid in full e-mail as soon as your loan is paid in full. You borrowed $500 and so far have paid the $150 fee. You still owe the $500 principal balance. If you'd like me to go ahead and take that payment tomorrow, I'd be more than happy to. If not, your next scheduled payment is on 04/15.

Apparantly, they think they got my $150 on April 1st, but they didn't. Amy, don't fall for their stupidity with the Indian reservation. You pay them back the principle when you can. Don't let there nonsense get to you.

Hello again, I was wondering if anyone knows where this phone number is to it's 1-855-868-2577. I got a call today didn't answer they did leave a message saying my file was brought to her but never did say which company it was, I swear I feel like I'm never going to get out from under this, there's only 2 loans that I defaulted on and are making arrangements with and they are cash net USA and payday one, due to I believe they are legal in Illinois but if someone has any info on this phone number that would be great, Thanks!!!

855-868-2577 This is TRS. They called me today and once last week. The lady stated today that she had left a message with my HR department and was going to do a wage assignment. This is for Everest Cash Advance for me and I have already sent them the letter as suggested in the sticky when I closed my account back in March. TRS claims they have no address and don't have to send anything in the mail. Next stop for me is the NC attorney general.

well if you haven't given your HR person a wage assignment revocation letter.do so as NC is non-garnishment.meaning even with a court order this bottomfeeding slime can't garnish,and while your HR person should know this.some honor these bogus things.so draft the letter and give it to your HR person.
