First let me start off with how glad I found this site. This forum has been so helpful with educating me on my rights!

Ok so I have a loan out with Plain Green. This is my second loan with them. When I found out they were illegal, I immediately send a revocation letter and requested that they apply the overpayment I made on the first loan to the principal balance on my current loan.

They replied back with this:

Dear Ms. XXXXXX:
Your correspondence has been directed to me for review and I thank you for the opportunity to assist you at this time.
We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal in the amount of $782.22.
To further clarity your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy’s Indian Reservation of Montana (“Chippewa-Cree”). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an “Arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is not a payday loan.
This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.
Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.
Please reply to this email if you accept this offer to settle your account and we can set up a payment plan.

Should I stick to my guns and demand the overpayment be applied to the principal balance? The overpayment was $685!! That would reduce the balance owed significantly! Please advise.

I too have a PG loan and had one previously that I paid off, of course paying off more than I owed. I live in Texas and called the OCCC. They told me that IF a lender has "Choice Law" in the contract, they can be legal. I mentioned the word "Illegal" lenders that aren't registered in my state and he said that isn't correct. He also mentioned if they're tribal, they don't need to be licensed in your state to lend money.

Please let me know what I should do - my situation is sort of the same as above.

If you stick to your guns with Plain Green, they should agree to it. I had to go back and forth a few times, but they were OK to work with, as ling as you holkd your ground.

I also have past loans that were paid off so i want them to concider that intrest towards paying off this one...How did it work out for you?

[COLOR=black]Thank you so much for posting this. My husband and I both pulled out a loan and feel stupid that we assumed they were like our local cash advance places here in Michigan. My loan was $800 and his was $500, both doubled with interest (we blocked their ACH almost 120 days ago). I have google key words looking for answers because I got an email saying they are sending it to a third party. I spoke with someone a few times and they were not willing to remove any interest. I would be willing to do a payment arrangement but NOT for double what I loaned. :( Can I ask what you wrote in your letter? I really would appreciate any help.[/COLOR]

For starters, register with the forum....you will get emails when answers are posted.

You borrowed from plain green?? Take control and be firm. Read the post in my signature line for information on how to deal with illegal lenders. Make sure you do ach and wage assignment revocations, giving copies to your bank and payroll department. If they send it to collections, respond like this.

Dear Collection Agency

I hereby demand that you cease and desist any and all contact with me and anyone associated with me. You are attempting to collect on an unlicensed loan issued by Plain Green, a tribal lender. Since they are unlicensed in my state of Michigan, the account you are collecting is invalid, the contract null and void.
