I know that if the payday lender is licensed in that are legal.. I went the Virgina SCC - Office of the clerk for a list of licensed payday loans lenders and none of mine were on the list...I would like to know where I can find out if they are illegal.. I know I need to pay back what I borrowed but some accts I have paid back principle amounts plus much more.

If your payday lenders are not licensed to operate in your state, then you will be liable for paying only the principal balance to them. You won't be liable for paying any interest charges or other financial fees. If you've paid more than the principal amount, then you should ask for a refund. Hi,

Yes, it is true that you need not pay the interest rates and other charges on a payday loan if the lending company is not licensed in your state, but you must always make sure that you know the needful in order to avoid any kind of further discrepancies. As you say that you???ve already paid more than the principal amount, you can certainly try asking about a refund. In case you want to pay the payday loans faster, you can also go in for payday loan debt consolidation. Bundle your payments into a single loan and make single monthly payments to become debt free sooner.

All internet payday loans are illegal in Virginia because the state will not license any lender that doesn't have a location in the state. These lenders have committed a Class 6 felony by making you a loan. You have not committed a crime by getting the loan. It is up to you whether you should pay them back, but I would like to see them not get repaid so there is some consequence for their lawbreaking. Be sure you close your bank account with a "hard close" so they don't debit it.

I've been doing research on illegal payday loans in Virginia and it is considered a Felony in the Commonwealth of Virginia to make an internet payday loan to residents of Virginia.

As of Monday I went and closed out my checking account... this week I will be sending out letters to the PDLs. I want to wait until I know the acct has been secured... I will check with them in the morning.. I felt so stupid explaining my situation to the bank but was amazed of how offend it happens .. I can not thank you enough for all of the help and information you provide on this forum... once I get out of the PDL hell I will be happy. I will keep you posted
