I have a few and last payday loans I will ever have for starters I will list them and what I have paid as soon as I get all together and accurate today. First Cash Direct I am having issues with. I have a work number that they are calling. I tried to give them my cell number which is how they can contact me at work at they wouldnt take it. Reason being I work for the government and the government phone is not for personal use and I have informed them and they say we are sorry but will continue to call it even if it jeopardizes your job. Can they continue to do this after I have told them to stop and I am communicating with them and trying to make arrangements as soon as I can with them and offered them a way to contact me at work?? Also I have one with ALPINE DIRECT or KENWOOD SERVICES.

Alpine Direct/Kenwood- Loan #1 $200 Payed $1100.00. Nothing more owed. Loan #2 $300 Payed $270.00 Wants $520.00 to pay off.

First Cash Direct- Loan $700.00. Payed $740.00 They want $1099.00 to pay off.

Check n go- Loan $700. Payed $1500.00 Wants $700 to pay off.


Hi NTEXAS,

Though payday loans are legal in Texas, I'm not sure whether or not First Cash Direct is licensed to operate in your state. Moreover, even though they turn out to be legal, as per the FDCPA laws, they cannot call you at your workplace, if your office policy does not allow it. Check n Go is your only licensed lender. Call them and ask for an extended payment plan.

The other 3 are not licensed in TX. I'm assuming you got all of these via the net?

Anyway, you need to close your checking account and get a new one. You should only repay the principal amount of your loan. If you've already paid in fees an amount equal to or greater than the principal, you owe nothing further. You can find detailed instructions and sample letters here.

What do I need to say when I call Alpine Direct/Kenwood Services about them not having a license in texas. Yes I have way overpayed them if I only have to pay what I borrowed. Good Luck on me getting a refund but I will try. Thanks again for your help. Much Appreciated. Get out of this mess and never get a PDL again.

Alpine Direct Services and Kenwood Services are the same company.
I have payed at least $1300.00 on a $200.00 loan and $390.00 on a $300.00 loan. The $200.00 loan was 2 years ago with Kenwood Services and Bank talked to them and they stopped and also requested a refund for me but no answer after that. New loan of $200.00 we found out they were same company. What should I do next ????????

This letter is to inform you that I am aware of the FACT that the loan you issued to me, is NOT legal or binding in my state. For your convenience, I have included my state payday loan laws below.

7 Tex. Admin. Code ???? 1.605; Tex. Fin. Code Ann. ???????? 342.251 et seq. and 342.601 et seq.

The state of Texas requires Internet payday lenders to be licensed in MY state. I have already researched this information, your company does NOT have a license to lend in the state of Texas, if I am mistaken I will need proof in the form of a license number so that I may verify it with my Attorney General. I am bound by the state laws where I reside. As I have no presence in your state therefore I have no legal obligation to the 'governing laws' you may have detailed.

Be advised that as of today (08/18/2011) I am revoking ANY and ALL ACH authorizations with your company from debiting any AND all of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I also revoke ANY and ALL wage assignments I may have signed, by you, including but not limited to; any of your affiliates, dba's, and collection agencies assigned to this account. None of the above no longer have my permission to access my accounts or impose a wage assignment.

I will only communicate to resolve this matter via email. If you ignore this notice and attempt to contact me or any of my references via telephone, you will be ignored and any payments owed will be delayed. I am willing to pay the principle amount of the loan only, however, no address means NO payments, this is not negotiable.

If you do NOT reply to this notice within 48 hours I will be forced to file complaints with my Attorney General Greg Abbott, the BBB and the Federal Trade Commission. If you reply to this notice with any misleading legal implications or menacing course of actions you are unable to follow through with, I will be forced to take actions against you and cause damage to your reputation, which could potentially decrease your clientele!


They Replied with this today:

I wanted to come to an aggrement for your account. I was close to making possible payment arrangements with xxxxx, but it was not successfully. A loan was taken out on 06/09/11 and as you are aware of our policies and circumstances that come along with accepting this by agreeing to the terms it is your responsiblity to take action. Every time we debit your account for the service fee an email notification is sent out. Only 1 payment of $90 has ever been recieved since loan was taken out. Please note that I do want to resolve this with a settlement that is beneficial for the both of us. Once again I am doing my best to accomodate you and your situation. If this is an option for please let me know as soon as possible. Your account will get picked up by a 3rd party collections and the are very extreme about collecting their debt. Please let me help you avoid that by a settlement here with me.

I also have debt with Alpine Direct - I got the loan back in March and since then have paid about $1080 (on a $300 loan). I like the letter you submitted and it seems they responded quite quickly.
I thought that in Texas, they have to start including a paydown after 4 payments (ie. $50 per payday, which then results in finance charge going down til paid).
I also have 2 other $300 payday loans CMG group and 3B Payday loans. I would like to send a similar letter to all three. I would be quite happy if the loans would just be marked paid in full - but would it be possible to be refunded an overpayment?

I can't believe it! It was so easy and it worked! I sent a letter via email similar to above to 3B Payday loans...I advised the amount I've paid and that I requested that it be considered paid in full. I should've asked for refund but honestly I just wanted the debits to stop. This is the response I received 30 minutes after I sent my email:

First Cash Direct Are very Annoying and Demanding...They continue to call my work. I speak with them every day sometimes twice a day. Is there something I can do to have email contact only. They tell me one thing and do exactly opposite.. They told me would stop calling my job and they didnt...Pissing me off so bad I really dont care if they are paid or not...???

How is it going with Alpine Direct? I have sent them 2 letters and I have not received anything in response. I have since filed complaints with Attorney General, FTC and BBB. I like you have grossly overpaid them..to the tune of 1350 on a 300 loan. How long did it take for you to receive the above response? Did you fax and email or just one of them? Thanks :-)
For anybody else..what happens after I file these complaints? I'm really trying for a refund as with two other companies (that have marked me paid in full) I've paid about $3900 on $900 worth of loans.
