Payday lending H-E-Double Hockey Stick
Marauders11:
I commend you for all your hard work and the ability to put these payday lenders in their place. Unfortunately, I have not been so lucky with Payday One. I sent a letter similar to yours, only to have them claim that they do not have to follow PA law as they are licensed in Delaware. I then made note to them that according to Delaware Law a loan could only have a maximum term of 60 days, which mine grossly exceeded reaching a term of 210 days.

This was their reply: Donna, PayDay One is in receipt of your recent email. Each time you make a payment, without paying the full balance, you sign a loan agreement. At the time of your signature, the terms and conditions of the loan, as well as the length of the loan, begin again. You may log on to the web site and view your loan agreements at any time. We have honored your request to stop ACH debits from your bank account. You remain responsible for the balance of $122.40 as of today. Late fees accrue at a rate of $5.40 per day. Your loan is currently 6 days past due. If you require payment arrangements, you may contact Account Services at 1-866-580-1227. We hope this helps to clear up any confusion. Thank You, PayDay One Special Handling Team |
My question is now what????
They don't have to follow PA laws, but they would have to follow
They don't have to follow PA laws, but they would have to follow DE laws . . . Keep at them! Don't back down.
One more question:
I am currently battling with a company called Westbury Ventures and a women by the name of Angela Morgan. I do not know this company or who they are affiliated with. I have requested that they send me a debt validation and proof that the supposed company they are collecting for is licensed in their particular state. She responded witha form for me to fill out for release fo financial information and to have this form notarized. The form reads as follows:

Personally, I do not want to do this because it appears by doing so I am acknowledging that I owe this company, when I do not believe that I do.
For them to provide the requested proof, am I required to follow these instructions?
You need to keep a roof over your head. Stop your direct deposit
You need to keep a roof over your head. Stop your direct deposit and open a new account in order to gain control back of your finances. Then deal with the ipdls one by one. Otherwise you are going to find it hard to take control back and run the risk of losing your housing.
Thank you

Thank you. I just recently became a member of this forum, but prior have read many posts that have helped me thus far. This is definitely a lifesaver for me and many others who have fallen victim to these pdl companies. I will definitely take things one day at a time and one loan at a time.

Definately stop your direct deposit and have your work cut you a paper check if needed--and cash it at the grocery store if you have to, but keep a roof over your head!
