Payday Loan Alabama Help: New Details

Hello. I have posted before.


I have 4 Payday Loans (all storefronts):
Advance America - $587.50
Check Into Cash- $235
Express Check Advance- $587.50
Cash Express- $470

They were all due today (Dec 11) and I was not able to pay.
I contacted the CFSA about the EPP option and the state of Alabama has this option for all lenders and I found the law stating so.


1. AA says they can, but they have to try and process the chk and it needs to be returned.

2. CIC- I haven't contacted them yet. I may pay the interested only of $35 if they let me and renew the loan.

3. Express Chk Adv- worst of them all. The manager is NO HELP. She says that's ONLY an option for persons who have lost their job. I told her I had the flu and my employer would not allow me to work and my funds decreased this pay period. This woman got extremely loud with me over the phone screaming that I took the loan I BETTER come in and pay it. I was not rude to her, I told her I spoke with her before and asked what my options were and reminded her what she said above and that if I had the money I would pay and that when I called on Dec 1 I was clearly trying to work with her as I've been a customer over a year and a half (she's been working there for about 2 weeks). I said I'm aware of the terms of the loan and they can go ahead and do what needs to be done as I've been in contact with THEIR corporate office. B*tch hung up the phone in my face.

4. Cash Express says they dont even have that option. But she says I can come by and pay the interest only which is $70. She's very nice, but misinformed about not having EPP apparently.

My problem is with the first 3 lenders, the bank closed my checking account because it was neg for over 30 days. Ala law says: Criminal Action: Prohibited (Unless check returned due to closed account).
Does it matter that I didn't ask for the acct to be closed? I wasnt able to pay the bank in time so they closed it and sent it to collections.

And how do I make them work with me on this EPP?


You need to be firm and complain to the CFSA, call them at 703-684-1029
and tell them these companies are NOT adhering to the CFSA's industries practices! Also tell the representative at the CFSA what AA said about processing the check first, that defeats the whole purpose of the EPP! You MUST stand up for yourself and demand these lenders honor the EPP or demand they have their membership be revoked! I would also tell the CFSA you are going to complain to your attorney general's office that their members are NOT following the industries guidelines! Call the corporate offices of these lenders and complain LOUDLY!

Quick update: Today (Sat Dec 12) I talked to AA and CIC. They both are giving me until Monday to come in and renew with just the interest. I've had some friends loan me some money.

Express called me but this time it was a reg employee and not the manager I spoke with before. Turns out, they do not like the new manager either. The rep called me from her personal cell phone after her official "when do you think u will be in" call and gave me their corporate office number, manager's first middle and last name, and told me to complain about her as I;m the 5th person THIS WEEK to say how rude this woman was and how horribly she speaks to the other employees.

I have the money to pay AA, CIC, and Express and I will update my bank info with them as I understand it's illegal for me to still be using the chks from the closed account.

As for Express, I am going to DEMAND the EPP when I call the corporate office as well as get this new manager at the branch out of a job.

I'm trying to get out of this trap and I have to do so one lender at a time.

Update:

I'm in an EPP with Advance America! :-)
No chk processing.
Called the corporate office and the VP handled it himself with the branch. I felt so powerful lol

Turns out CheckIntoCash DOES NOT do ANY rollover (verified with their corporate office) even though the law says we are allowed 1 in Alabama. So basically I had to default. I'll update on how that turns out. It's only $235...maybe they can work something out with me. I dont want this on my credit report.

Express Check Advance and Cash Express are pretty much the same. I renewed the loans as I can only handle one EPP at a time.

I have had multiple checks with cash express before. I went in and asked for an EPP on one check before the due date and could'nt get an EPP and in fact the manager got kinda rude about it which really po'd me since I had been paying on multiple checks with them for well over a year and had never been late. I have since paid them all off. I'm not sure what the deal is with them because they are definetly listed as a member of CFSA but so far I don't think I have ever seen anyone post getting an EPP from them.

The lenders who are members of the CFSA need formal complaints filed against them with the CFSA for NOT adhering to the guidleines, these complaints need to be sent certified return receipt requested, in the complaints I would mention that you are sending a copy of the complaint to the attorney general's office in VA (where their office is located) and ask that their state attorney general step in and DEMAND the CFSA enforce the guidelines upon it's members or revoke the license's of it's members for not adhering to the set forth guidelines. If more people who come across this problem would follow through with complaints of this nature, the better the chances of having these lenders investigated.
