Hey everyone i need some additional help here with these 2 companies, VIP loan shop and fast efunds. So i have determined that vip loan shop is not licensed in my state, which is California. Havent found too much on fast efunds but i got the loan from fastefunds through the vip loan ship so i am assuming its the same. I took out 2 500 dollars loans because i was tight on cash and then they all of a sudden doubled the interest rate even though the contract (even tho the contract to my understanding doesnt apply to me because they do not even have a license to do business in california) states "On the due date, your loan will automatically be extended for an additional equal term unless you notify us that you decline such an extension." This "equal" term should have kept it at 75 dollars in fees. So when they raised it all of a sudden to 150 dollars (this is per loan mind you) i was pretty upset. I found this site and read the step by step. Closed my bank account so they couldnt take more money out and sent both companies an email stating my findings. I am reporting them both already on the BBB website as well. My question is what should i do should this show up on my credit report? How do i go about getting that removed if in fact it goes that far? They have yet to respond to my email. I offered to pay back the principal minus what fees i have already payed. Any guidance on this would be helpful. Such a pain in the ass it really was a last resort loan. In fact when they told me the fee would be bumped up to double i told them im just going to pay off the whole loan and they told me they would STILL charge me the interest fee. Luckily i found this site and read the step by step thread which saved me the money in fees. Im just worried about it hitting my credit report.

In California, you need to report them to the Dept of Corporations, as they are the state governmental agency that handles this. You can find complaint forms on the California.gov website. The only drawback is that they are overwhelmed, so it might take awhile, but they do respond and get back to you.

ahh ok i see, i thought reporting to the bbb somehow was record of my complaint. These guys still havent emailed me back, but my payment date is not til the 31st so im sure once they try to take out money from my closed account they will try to contact me. My bank told me too that since my account was closed nothing can come in or out, and i have called twice to verify this because i read on here that other people had issues with bank of america.

To start with, did you also revoke ACH before you foreclosed your bank account? Revoked volantary wage assignments? If not, you need to do those. Pay the balance of the principal using either a money order or a prepaid debit card.

As for these illegal lenders reporting on your credit file, they usually do not do so but in case they are stupid and they do, you can just dispute it in writing (stating that the loans as well as the lenders are illegal) and have the tradelines removed from your report.

Reporting to the BBB is pointless. They are not capable of doing anything substantial. You actually need to file complaints with the AG and the FTC.

I think they might have a fax # on their website. Print out the Desist & Refrain order that's available and fax it over w/ your email that you have sent over to them. Keep the fax confirmation for your records.

Thank you for that reply eeyorelover79.

So now of course they are calling me constantly and they have not replied to my initial email. When I answered the phone and explained that i emailed the customer service email that was posted on their website they stated that they do not conduct business through email. I told them I dont want to talk to them then because I need proof of the correspondence we are having. Another time they called I ended up reading the email i wrote to the guy over the phone and he said that he will mark my account as "refusal to pay" and send it to collections. Unfortunately this failed to stop the calls. Is this just expected? what other steps should i do. So far i have only sent that email and it seems to have fallen on deaf ears. Again I just worry this will hit my credit report. Also when i read the email to the guy over the phone with my terms (stating how much i have paid and how much I am willing to pay back) he said they will never go for that, and then he said he is going to mark it as "refusal to pay" even tho under my terms I would be paying back what I borrowed. Help me out here guys

Rollovers are illegal in CA as are the lenders....stay off the phone period. BBB complaints are a waste of time...they cannot do squat. You owe principal only, no interest, no fees. Keep emailing them and report them to the CA AG's office and the FTC
