pLEASE HELP ME

So I took out some payday loans a few years ago, probably like 3-4 years ago and have not paid anything on them. I am now trying to get a financial plan in order to take care of my debts but I have no job now so it is hard but I am trying.

Today I get a call from someone saying they represent atty john nicolia and they have a pending civil suit against me and they gave me a case dockett number and said if I do not pay the now $600 dollars I owe they will send out the papers to my county and I will get a subpoena.

I asked for them to send me something in the mail showing what I owed and all that and they said they can not do that but they can only send me a email.

I am going to pay what I owe when I can but should I really be stressing like I am over these people? I have read that these people are some pretty shady people...HELP


Have you checked with the case number that they have given you? I think you need to inquire if there is at all a pending case against you. It can simply be a scare tactic to make you pay.

I also think that you need to send a debt validation letter as an initiative to deal with them.

send out a debt validation letter, but what would raise red flags with me is a person that says they cant send you anything.

Anybody can tell you over the phone to do this or you owe that..... but proof is in the pudding..........

Ask for proof, and after being on this forum make sure the companies are legit............

Never pay any type of collection agency without debt validating them first and them sending you written proof that you owe the debt.

I would also do as suggested and call your local court and see if there is in fact a case pending against you. The court can easily look up by your name and since they gave you a dockett # they can also tell you if that is one of thier numbers. My guess is...the guy who called you is full of it.

I agree with resqume1; ask them to send you a letter on company letterhead detailing exactly what is owed and who they're collecting for, see what they say to that. You might also want to call your State financial regulatory agency and/or attorney generals office to see if there's any complaints against these people.

Well I looked up my name on the public court records and there is nothing with my name anywhere in the system. I told the guy who said he was one of the attys to send me something showing that I owe them something and he all he could do was probably send me a email and I said I wanted something in writing. He said that since he is not the orig place I had the debt with he can not send me anything in the mail. He said the only kind of notice I would get in the mail saying I owed something is when I get sent a subpoena. I asked him what the original amount of the loan was, which I know is $150, and he said he could not tell me since he did not have my file pulled up, so hmmm I owe over $600 when the orig loan was for $150, I know I have to pay fees for being late and a nsf fee for when they tried to take the money out of my account long ago..

I cant wait till I completely pay them off
