Hello,

I defaulted on a payday loan with Fireside cash. I owe 350 on the principal.

The loan has gone to collections: Admin Recovery Systems. They have been calling me at work and home non-stop for the past couple weeks. I advised them to not contact me via telephone and further correspondence in writing. The rude woman said I could 'hard settle' out of court during the last conversation. I'm pretty sure it was a scare tactic.

The debt collector is licensed in Maryland, however Fireside is not. I recently checked Fireside's website and they don't speak of payday loans anymore, but installment loans. I no longer have a copy of the contract.

I have read all of the steps and will contact Admin Recovery with a C&D letter. However, I am concerned they can take me to court and collect because they are licensed in Maryland and it now shows Fireside does not make payday loans but installment loans.

Any thoughts or advice?

Have they called you at work since you verbally told them NOT to call. If so, that would be a major FDCPA violation. Actually continuing to dunn you after telling them not to would a violation. They cannot sue you on an illegal loan.

Fireside Cash is an illegal offshore payday loan lender. Payday loans are prohibited in the state of Maryland. Therefore the note you are collecting on is null and void.

Hello Soap Lady,

They have not so far, but it has only been one day, and they emailed me their demand letter. I will send your suggested C/D letter via certified mail. I was scared because I looked up that Advance Recovery was registered in MD and Fireside changed their language recently from payday loans to installment loans, so I didn't know if they had some sort of technicality on that aspect.

One thing I left out, when I told the lady the loan was illegal, she replied "you took out a loan on the internet" it was her only rebuttal besides, "so you take money and don't pay it back?".

Installment or payday loan does not matter given that they are offshore. You have nothing to lose sleep over. The internet rebuttal is the usual one, means nothing.

the MD DFI does alot to fight for MD residents.report both the lender,and the collector to them.just because a collector is licensed doesn't mean they follow the laws.they can be reported just the same as a bottomfeeder.btw doesn't matter what they call their loans.they are offshore and illegal anyway.last thing.how did a place in NY get licensed/registered in MD?

Paul is correct. The Maryland Commission of Financial Regulation takes a hard stance against illegal lenders. You can contact them at 500 North Calvert Street, Room 402, Baltimore, MD 21202, 410-230-6100, finreg@dllr.state.md.us. Give them a call they will be a great help.

I sent my CD letter today via certified mail and email to their admin assistant. I'm curious if I will receive any sort of rebuttal from them and what type of rebuttal it would be.

I am a Florida resident and have an account with Fireside. I have Payday Support Center LLC hanling several pay day loans from me. Fireside continues to have legal firms calling saying that I will be serviced with a summons for a court date and that they will garnish my wages. Can they do this?

sorry,but payday support isn't doing jack,and in the long run you will be on here posting on how you were scammed by them.have you informed payday support of this,and what was their response?bottomline them calling your job after you tell them not to is not legal.have this place handle it.that is why you are paying them.

Yup, you are wasting HUGE money using payday support...legally you dont owe Fireside a penny...the contract is null and void. Quit wasting your time and money with them...they really do not care about you, only their fees.
