I am a Florida resident.

I have tried to close my bank account but was told that it would re-open when they put through another ACH. I have letters for all of these comapnies, but cant find addresses to send them too...

Help.

So, I spoke with my bank and they said that all of the ACH debits for these were coming from other financial institutions so therefore were legal and valid? They also said that they couldnt help with closing the account if the debits were valid. Its Bank of America.

I am just getting started myself am planning to go talk with my bank today but from what I have learned here:

Go talk to your bank in person, don't talk with the call center.

If you need to, ask to speak with the branch manager.

Tell them you found out these companies are illegal and take copys of your ach revoking letters.

If all else fails go to another branch and repeat.

Just wondering have you actually gone into the branch or is it just the call center you are talking with?

TAke a copy of everything in writing, ACH revocation, state law, illegality of the loans. Also remind them that continuing to allow the ACH makes them a party to illegal banking activity. IF it crosses state lines, it is Federal. This is what I had to resort to in order to shut down my account once and for all. Just keep reminding them that allowing an illegal monetary transaction is against State, Federal and FDIC regs. It made my bank cave pretty quick.

I did go to the branch and spoke wit hthe branch manager... she told me to call the companies main number and speak to the fraud dept. I did, they transferred me to the Credit/Debit customer service dept. who told me that the only thing I could do, was to send the companies the letters and pay them by money order, but that since the ACHs were coming from banking institutions, they were valid. Maybe im not explaining this to them correctly?

I bank with BOA also and I closed my account about a month ago. About a week before I was going to close the account I stoped my paycheck from being direct deposited and opened a new checking account online. The next Monday I went into my local branch and just told them I needed to close my checking account because someone got my account number that shouldn't have it. That is the only explanation I gave. They closed the account with no questions asked. I called everyday for a week to make sure the account was fully closed and that nothing would come through. I'm sure they got tired of hearing from me. Nothing has caused the account to re-open. I still get the insufficint funds notices in the mail but they just say the ach was returned and the fee was waived. I hope this helps.

I told them about the illegal companies and that I wanted to close the account. (we have another account with them that is separate). I was told by the branch manager that even if they close the account, that if they try to send through another ACH debit, it will re-open it, so there was nothing they could do. That wa when she told me to cal the company main line and speak with them about setting up a plan to py back the negative amount on the account.

That is BS. You have the right to revoke an ACH transaction three days before it is due to post.

That is the federal law. If the bank allows the ACH to go through when you show proof they have been revoked then the bank can face charges and fines.

I would take the letters that you are going to send to the PDLS. Take them to the bank and tell them you have sent them out but the companies, BECAUSE THEY ARE ILLEGAL, are contuning to take your money.

Show them the Federal Laws that state you can revoke and ACH three days early. You can find the law here under 3 (c). Print that out and take it with you along with the letters.

Tell them if they do not freeze/close your account you are going to call and complain to the FDIC and any one else you can think of.

These are your rights. Stand firm and do not take no for an answer.
