Great info here in the forums. I live in Massachusetts and took out a loan from sureadvance for $700. To date I have paid back $1120. I followed the advice on these forums because they are not a licensed lender in MA. I recieved a reply today from them and need to know how to answer them.

It appears that you may have misunderstood our terms as we are licensed in the state of Delaware. Your loan request for money was applied here in the state of Delaware via the internet. Therefore, the laws that are applied to this loan are those for the state of Delaware and none other as clearly stated in your contract which is legally binding and you agreed to.

For your 2nd and most recent loan, we funded you $700.00 on December 21, 2011 which was deposited into your personal checking account. That loan amount carried a finance charge of $175.00. As of today, being as though your opted to make minimum payments only to roll your loan over to your next pay date the current balance is $700.00 ($560.00/Principal and $140.00/Finance Charge). Due to the terms and conditions that you agreed to and signed by electronic signature on December 20, 2011 via your designated IP address, your account is not paid in full and you would not be due a refund. I have placed your account on hold which means that the interest accrual as well as any ACH debits will cease, however since customer service is my ultimate goal, I would be willing to offer you a settlement of $350.00 due by 4/27/12. If you would like split the amount and pay $175.00 on your 4/13/12 pay date and $175.00 on your 4/27/12 pay date, I am willing to accommodate that for you. Please let me know if you would like this scheduled to debit from your checking account that we have on file or if you would prefer to mail the payments in to our office via certified check or money order.

I hope to hear back from you soon regarding this matter.

If I am correct in my assumptions they are bound state law by whatever state they do business in. Also, I think they are in violation of Delware laws as I think they have a max $500 for this type of loan.

Hi,
I don't think there is any point in reporting the payday lender to the Delaware AG. Just report them to the Massachusetts AG as well as the FTC.

As far as payday lending is concerned, it is an illegal practice in MA and you, being the borrower and a resident of MA, are subject only to the laws of MA. Send them a cease and desist letter along with a demand for a refund of the amount you paid in excess of the principal amount.

class is in session.first the laws of the state the borrower resides in apply meaning no pdl is legal in MA.second you overpaid by over 400.00 on the current loan.go to either ohiogal's,or soaplady's signature and hit the sticky on dealing with illegal lenders.now as for their stupid email respond like this.

since i am not a resident of delaware my state laws apply,and therefore am demanding you refund the over 400.00 i overpaid.

respond that way,and know your state law applies not theirs.

Havent heard back from SureAdvance yet but got an email today from lender #2 CashCure basically saying the same thing as Sure Advance.

I sent them back an email demanding my overpayment back (like $148)....

Still waiting to hear back from Lender #3 (Red Stone Cash)

It will be interesting to see if I get any of the overpayments back.

Thanks again to everyone who provided assistance and to Ohiogal's great post on dealing with these people.

I am sure there will be more to come :)

Hopefully someone will see this from SureAdvance and respond :)

Being as though Customer Service is my ultimate goal, I will write off your remaining balance and consider this matter closed. We will not issue a refund due to the fact that the term of the loan was not satisfied. However, there are no further monies due to our company by you and your account is now Adjusted in Full.

I hope you are satisfied with this resolution.

being they are illegal in your state are under no obligation to refund.you can resend your request,but they may block your IP.it's your call.

Just to give you a little help regarding your Cash Cure acct. I am from PA and PDL's are also illegal. My state just issued an order to Cash Cure for illegal lending practices on 03/19. They had 10 days to respond. I talked to them last week stating that I wanted them to close my account and they said that they do not issue loans to PA residents anymore but I still needed to pay them. I asked the customer. rep. if they answered the complaint and they said absolutely. I contacted the PA Dept. of banking regarding the order and they suggested that I call the legal team. Well before I did that I checked my E-mails and there was one from Cash Cure stating they have closed my account and considered it paid. I responded with a thanks and asked them to refund me any money that is due, which I am not sure if there is any because I will have to go back and look at my statements. So maybe you using this senerio might help you get your account closed. Good Luck!
