Fraud charges on Payday loan

I have been contacted by a collection company threatening to serve me with papers for fraud charges for a payday loan that was taken out in February 2012? I don't have the funds available to make the payment this week they are requiring... Can charges such as this be filed?

Who is the collection agency???? They are breaking the law!!! They are scamming you....debts are civil, not criminal.
