Are these legal companies in IL

Hi experts,

I was successfully able to put a hold on my bank account... thanks to some fraud company which tried to take away $148.99 from my account and bank happily recorded the fraud and helped me in putting hold on the account. The bank has given in writing that no company can process ACH from this account and the account will not be re-opened.

Now the next steps.. dealing with payday companies...

Below are the loans and their repayments so far. Can you advise me if these companies are legal in IL and I need to work with them for some payment plans or when they call I can let them know that they are not legal in my state. Also, is there any specific letter I need to send these companies.

United Cash Loans - Taken 500 paid back 600
Integrity Advance - Taken 300 paid back 590
500 Fast Cash - Taken 300 paid back 500
Get Cash USA - Taken 600 paid back 904
Genesis Financial - Taken 300 paid back 140
Eastside Lenders - Taken 300 paid back 667
All Credit Lenders - Taken 300 paid back 518
Advantage Cash Services- Taken 450 paid back 135
Payment Direct - Taken 200 paid back 356

They all are going to come after me once their ACH is returned and I need to get ready for the battle ASAP.. Any advice is of great help!!!


Genesis Financial Services is a legal lender.

United (is this United Cash Express?) If not, they aren't licensed.

Integrity Advance, 500 Fast Cash, All Credit Lenders and Payment Direct are not licensed under these names.

Were any of these storefront loans or are they all internet?

All the loans were internet and none of them were from storefront.

I believe United Cash Loans and United Cash Express are same companies based on some research I did.

How can I find real names of Integrity Advance, 500 Fast Cash, All Credit Lenders and Payment Direct to ensure they are not legal. I am trying to search through http://www.idfpr.com/dfi/ccd/ccd_licensees.asp but it does not show any information on these companies.

Thanks... how would I deal with these companies.. I have already paid in full to all these companies and have hold the bank account. Is there any e-mail I would need to send to these companies so that they don't try to process ACH from my account.
Also, I had given my office number to all these companies, how can I stop them from calling me on that number?

You can't really stop them from calling. They are doing business illegally afterall. Just send an email to their customer service address and tell them that you've discovered they are not licensed to lend in your state, therefore the contract is void and you are willing to repay the principal of the loan and only that amount. If you've overpaid, ask for a refund. If you still owe them some money, set up an arrangement to pay via a money order (through the mail) or via a pre-paid credit card. Do NOT give them any new account info. Just tell them you no longer have a checking account. Also include language in the letter stating you revoke any ACH permission you've given and any wage assignment you may have signed. Give a copy of each email to your bank and your HR department. Request that all contact be made via email and/or postal mail. Also, file complaints against all of these companies with your state's Attorney General and the FTC. Your account is already safe. That's the most important step.

You'll start getting calls. And they'll argue choice of law. Just stick to your guns. They'll stop eventually.

Also, contact your 1 legal lender and set up an alternate payment arrangement. Just tell them your account was closed due to some suspected unauthorized/fraudulent activity.

I found that Get Cash USA is licensed in IL as:
ZOA, LLC
D/b/a Get Cash USA
5205 West Fullerton Avenue
Chicago IL 60639

I also started looking at the agreements and this is so far I found with Get Cash USA and United Cash Loans. Does this make me payable to both companies for the loans I have taken although I have paid more than what I had taken.

Get Cash USA -
Choice of Law: This Agreement has been made in and shall be construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law rules.

United Cash Loans-
Governing Law: Both parties agree that this Note and your account shall be governed by all applicable federal laws and all laws of the jurisdiction in which the Lender is located, regardless of which state you may reside, and by signing below or by your electronic signature, you hereby contractually consent to the exclusive exercise of regulatory and adjudicatory authority by the jurisdiction in which the Lenders is located over all matters related to this Note and your account, forsaking any other jurisdiction which either party may claim by virtue of residency.[FONT=arial][SIZE=-3][/SIZE][/FONT]

I also found that All Credit Lenders operate as CMK Investments and are licensed in the state of IL.

Can I work with them on repayment plan since this company falls under customer installments loan companies. The way they have setup the payments are with finance charges of over $1500 for $300 I had taken. I have paid $518.

Also, I am not willing to share my new bank information with these legal companies but can pay them back through Moneygram or other means.

ah yes i have dealt with them as well.unfortunately they can enforce the terms as they are not a pdl,but an installment lender.yes the interest is borderline illegal,but they have you.but all credit should take moneygram or a prepaid debit card,but no you shouldn't have to give new bank info to the legal lenders.they worked with me and they should work with you.

So.. now that I have "defaulted" the ACH... I got a call from All Credit and Get Cash and told them truth as they both are legal in IL.
All Credit and GetCash USA mentioned that I would need to make the payment first at any store location but cannot send money via Moneygram or other source. They mentioned that they can work on payment plans once they receive the pervious payment.

Also, I got a voicemail from Payment Direct which I believe is not legal in IL. Would it be okay if I send them an email that you guys are not legal in IL and I have paid the principal back hence I do not owe anything?

The payday companies started calling me and are asking for debit card information on some sort of recorded line to secure the payment. I told these companies that they are not legal in my state and have already sent the mails accordingly.

What is the best way to deal with these companies apart from sending mails.
