Geneva Roth did it again, they tried to take money out of my new account. I have read on here that I should go through my bank to file a fraud claim since they did not have authorization to take the money out of my account. However, my bank told me that they could take the money out of any account that I had because I made an agreement to pay money to Geneva Roth. What is the correct course of action now? Because Geneva Roth never had my permission in the first place. Any advice would be most appreciated.


first draft an ACH revokation letter.send it to the crooks at geneva.then give a copy to your bank manager.if you already did this,then file a complaint against your bank.if not get that letter sent asap.once that is done,anytime these clowns attempt a debit it is fraud.do this as soon as you can.

You made an agreement to pay them, yes.

What bank do you deal with? You can revoke them from debiting your acct, and pay them on your own, you need to speak with the branch manager, and if that doesn't work talk to his boss!!!!!

You say this is a new acct, how did they get the acct number in the first place? You can file a fraud claim if you told Geneva not to debit your acct anymore, if not you need to type up a letter stating that fact and save a copy to show to your bank. If they won't help you then close that acct all together and go to another bank..

This company is horrible.. I've posted on here b4, and they totally wiped out my checking account, not only one time but 2 times. I did what you did and got a new checking account, even at a different bank, but some how, some way, they found it out. So needless to say, I no longer have a checking account, and probably won't for a very long time. I filed fraud charges and a police report,, but didn't really help. I wish u lots of luck, with these people.

October 1, 2008

To Whom It May Concern


I, Kody Thomas, am revoking your company and any sister companies that you may have rights to, to debit from my account.

I also revoke any voluntary wage assignment that I may have signed.

Also at this time I am making this also my cease and desist letter. I wish that you do NOT call my home, place of employment, family or friends listed as references to any account or email, I want to only be contacted by mail. I also want a statement from you stating what exactly that I owe and any payments that have been made to the account. According to Indiana law the Pay Day Loan Lender must be licensed in the State Of Indiana in order to lend in Indiana . According to the Indiana DFI, http://extranet.dfi.in.gov/dfidb/nondeplist.aspx, you are not a licensed lender in this state therefore making the contract void. Also in the state of Indiana, you are prohibited by law to make threats of any nature. You are also only allowed to charge 13% on the amount borrowed as the finance fee. Meaning that on $300 you are only lawfully allowed to charge a $39 dollar fee, not $90. Out of state lenders must head to Indiana laws of lending according to Indiana state law.

I am willing to pay the amount left of the original amount borrowed. But in order to do that you need to send me what I requested. Copies of the original agreement with signatures, also documents of any payments that have been made and what the original amount was. This goes the same with any payday loan company that you may have on file for me. I do not have the account number so I trust that you will take this info as sufficient. I have also contacted my payroll office and told them that no company is allowed to take wages from me.

i know that this company or it's sister companies aren't authorized in indiana. my orginally loan amount is $300 with the $90 charge added to it. taken back in december of 2006. 3 payments of $90 have been cleared and taken out before i closed the account through bank of america. i am willing to pay what is left of the principal amount but no more. i feel it's only right to repay the amount that i borrowed.

I also got threatned with the whole i'm on the phone with the sherriff in your town issuing a warrant blah, blah. well that was almost 2 years ago and still not arrested. :P
