Geneva Roth deposited more than the borrowed amount
Date: Mon, 06/25/2007 - 08:44
I have a loan with Geneva Roth....the loan ammount was for $400.00 they deposited $800 instead....I called them and told them what they did and they told me it was my lucky day...I told them that I couldn't afford the loan of $800 and they said that there was nothing they could do about it, that I would have to payback the interest on the FULL ammount. I talked to T&C and they told me to put a stop on the ACH through the bank, and also to send over the letter revoking the ACH to Geneva Roth.
I did that and the bank said that they would work with me...I woke up this morning and there has been $240 in fees taken out of the account...I called the bank and they said that because the company ID was off by one digit, that they couldn't stop it, that I can file a dispute and they would get my money back, and try once again to get a block on it.
I then called Geneva Roth, and asked why they still debited, and they stated that they do not accept written revoke letters. I am in California, and I am not sure what to do. I really don't want to close my checking account, as this has been my account for so long....I would like to pay them there $800, but can't do it all at once, but can't afford for them to take $240 every two weeks...
Help Please

It was very unprofessional of Geneva Roth to deposit more than what you borrowed and then consider it as your lucky day. You should make every arrangement to return their principal amount. Ask your bank to block their transaction id through which they debit from your account. Doing this, they won't be able to take out any money even by using different amounts. You don't want them to take out all your money just in fees only.

Any loan company must be a licensed business in your state before they can lend money to the borrowers. Check with the Dept of Corporation of your state about their business. You will know about their other DBA names.

It is a violatin of Federal Law to require ACH as the only form of payment. File a complaint with the Attorney General in Kansas where they are located. Also the BBB in Kansas. These people are the worst to deal with, They think they are Governed only by the laws in the state where they are and are unyielding. I am presently in the midst of a war with them which may eventually wind up in federal court which is going to cost them a lot more than the hundred and something dollars I am trying to get from them. The owners name is Rebecca West. You should address all correspondence to her. Unfortunately you will have to close your account if your bank cannot put it on deposit only status. Call your payroll company and request a "live check" until you have a new account in place.

Frogpatch is correct. That is a load of bull they are feeding you saying they do not accept written revokation. That is a federal law, and it isn't up to them to pick and choose which laws they will abide by. Wouldn't it be a scary world if we could all operate by the ethics of these internet pdls, just pick and choose which laws we like and follow them, and disregard any law we feel will cramp our style!
