It has been over 5 months since I have been harrased last time from Webpayday. 5 months ago they had Phoenix debt management keep calling me everyday asking for $160.00, they even threatened me with a court case, the women over the phone says, "you have to hire a lawyer, you are going to jail." Eventually I came here and got the information to send them a debt validation letter. I did and the after 2 days i got a call from Phoenix Debt Management telling me they couldnt give me any information or documents concerning this loan. What nonsense, I told them to send me a letter in the mail validating this debt and they said they can't. Eventually after 5 months they get AIS Services, LLC / Web Payday to send me a e-mail. The e-mail reads...

Should I send them a debt validation letter also? And why doesn't webpayday stop? All they do is harass with multiple debt collectors. I need help ASAP because they cannot produce the information needed for this to stop.

They are obviously not sending you debt validation documents because this isn't a valid debt, if they are an illegal PDL. And therefore, they cannot legally collect on that debt or send you to jail so that is why they are now trying to send you a settlement offer instead.

However, what state are you in, and how much did you originally borrow from them and how much have you paid back so far? If you have already paid them back the principal in fees, then you really shouldn't give in to them and let them get more money out of you. But that depends on how much you borrowed and how much you have paid so far. Even though most of these companies are illegal, I do believe in at least paying back the original amount that was borrowed.

I had taken out only $300 to help pay with some old bills. I have paid them the prinicple back, and they still ask for money. I am going to send them a email and a return receipt letter in the mail. I live in New York. I just checked the legal status for paydayloans for the state of Georgia, and they are prohibited. And guess what webpayday is from Georgia!

WebPayDay
Company: FFD Resources II LLC
URL: http://www.webpayday.com/
Address: 3343 Peachtree Road NE Suite 800 Atlanta, GA, 30326, United States
Telephone: 1-800-814-5451
Fax: 1-800-814-4960
Email Contact: info@webpayday.com

http://www.debtconsolidationcare.com/paydayloan/laws.html

http://www.paydayloaninfo.org/state_detail.cfm?id=GA

the 2 links above both say pdl's are prohibited in Georgia, so what is the next step i should take?

Awesome, paul! zman, WebPayDay is wacked, okay? I've had them. Whoever they have turned you over to (Phoenix debt management, AIS Services, First Shore Credit) send them a debt validation letter. Every single one of them. They can't properly validate the debt. It's not a legal debt. However, do this for your own documention and file, file, file complaints against WebPayDay and every collection agency they've used so far.

zman, watch out for them though. Once they turn you over to collections, the collection agency will hit your credit reports. If this happens, don't sweat it. Just dispute the living hell out of it and have it deleted from your reports.

If you need anythihg, just post!

At what point do you send a debt validation letter. If i borrowed 300.00 and paid back $180.00 and the PDL states I owe $510.00 and would not eccept my offer of $120.00 left owing on the principal borrowed, do i send the letter now asking them to validate the debt? or are debt validation letters used only when the debt was paid off or not yours to begin with. not sure if my question makes sense.

They are not licensed in my state.

white, we send out a debt validation letter once it's been turned over to an outside collection agency. You can argue your head off with the pdl. Which is fine. You can banter back and forth and dicker with amounts. It's when they turn you over to someone else, you can slap a debt validation letter on them. They're never able to properly validate the debt. It's an illegal debt.
