Stumbled across this forum in a desperate search for help and I'm posting for some advice. I live in NJ and I currently have 7 payday loans (down from 9). I fell into the trap and ended up needing to get one to make ends meet because of the others, justifying it that I would pay them off when my tax return came. Well, my tax return came and went and I only got 2 paid off and now I'm in deep trouble.

Here is my loan information:

Everest Cash Advance (West Indies)
borrowed $300 on 09/20/12 and have paid them $835.50
According to them Payoff is still $225.00

Ameriloan (Tribal) Have taken out at least 6 loans with them in the last few years
borrowed $600 on 11/28/12 and have paid back $950.00
According to them Payoff is still $715.00

Integrity Advance (Delaware)
borrowed $500 on 09/10/12 and have paid back $1,330.00
unable to determine payoff, 2 email requests have been ignored. Reminder email only references interest fees

US Fast Cash (tribal - OK) Have taken out numerous loans from them in the past few years
borrowed $650.00 on 12/26/12 and have paid back $585.00
According to them Payoff is $845.00

One Click Cash (tribal - NE)
borrowed $750.00 on 01/15/13 and have paid back $450.00
According to them payoff is $975.00

Eastside Lenders (Delaware)
borrowed $600.00 on 11/15/12 and have paid back $1,047.50
According to them payoff is $715.00

FedFinServices dba Payday Loan Nation (United Kingdom)
borrowed $800.00 on 01/23/13 and have paid back $360.00
Unable to determine payback

Advice? Continuing to pay everyone at this point is out of the question. I'm so behind on other bills at this point, things are getting ugly. I'm a single mom on a fixed income and I'm afraid of harrassing calls on my job. My place of employment would not look well on this because of our professional image. Anything you can offer would be appreciated.



Welcome to the forum. You have come to the right place. Will be some work on your part but eventaully you will be payday loan free! Tell your employer that you have been a victim of a scam and to ignore the calls. Keep us posted on your progress. Remember we are here to help.

process in december and i have received two paid in fulls, two willing to go with just the principle and a few others that wont budge just yet. I finally have a full paycheck as well. Its a process but stick with it. You owe only principle, and dont let them scare you into paying more. None of them ever called my work but I made sure they only contacted me by email or regular mail and so far they have. Close out your checking account immediatley and open a new one. And start sending out emails revoking ach and any wage assignments.Follow the steps Ohio Gal has posted. If you do this next paycheck will be yours to use on bills not payday loan interest.

Well, heard back from the last of them. They basically said that the loan agreement is a valid agreement under the tribal law and since they are tribally owned, they are not required to have a license to lend in your state.

I responded with this: With the help of the Attorney General's office, I have discovered that because this loan was not made on a tribal reservation and I am not a tribal member, I am not bound to tribal law. Legal presidence has been set so despite your claims of tribal sovereignty, regulators have ruled that tribal lenders are noe exempt from federal regulations. I owe $65.00 in principal so I denied their settlement request of $260.00 and told them to reissue my settlement with that offer and I will promptly make payment as I have the prepaid debit card ready to go. Or I can call and pursue my complaints with my Attorney General, Better Business Bureau and the FTC. And since I have had a total of ELEVEN loans in the last 5 years, I will be seeking to recover the illegal interest on those loans as well. Hey, they aren't the only people who can come up with crazy threats....fingers crossed!

I SENT OUT LETTERS TO EVEREST CASH DEMANDING A REFUND OR I WILL TAKE LEGAL ACTION!! THEY ACTUALLY REFUNDED $288.00!! BUT THEY STILL OWE ME $313.00! I EMAILED THEM A THANK YOU LETTER BUT DEMANDED I GET THE REST TOO!!! WHAT THEY DIDN'T KNOW IS I HAD CLOSED MY CHECKING ACCOUNT & OPENED A NEW ONE SO THE DEPOSIT FROM THEM WENT INTO MY OLD ACCOUNT BUT MY BANK SET IT UP TO WHERE THEY CAN DEPOSIT MONEY IN OLD ACCOUNT & BANK MANAGER WILL TRANSFER IT TO MY NEW ACCOUNT! WITHOUT THEM GETTING MY NEW INFO! MY BANK MANAGER WAS SO COOL ABOUT IT! I TOLD HER THE HONEST TRUTH ABOUT HOW I TOOK OUT A LOAN THAT WAS ILLEGAL THEN HAD WHITE HILLS CASH LOAN THEY SENT ME AN EMAIL SAYING MY LOAN WAS PIF BUT I SENT THEM AN EMAIL BACK DEMANDING MY $600 REFUND FROM INTEREST & FEES! I ALSO TOLD THEM I BETTER HAVE A PAPER CHECK IN THE MAIL WITHIN 10 BUSINESS DAYS OR I WILL TAKE LEGAL ACTION & SHUT THESE COMPANIES DOWN! CAUSE THEY ARE ILLEGAL PREDATORS TO CONSUMERS!!!

Thanks...what was the reaction from them like? Did they harass you a lot? I don't care that they try and harass me but I CANNOT have them call work.

Great advice for him singlemom....stick with it!!! Get your bank account closed asap, and let them know at the bank whats going on. Then write the ACH revokaion letters. Also in those letters, say you will only communicate via e-mail and postal mail. Use OHIOgal's format. That's what I used. The ones you have paid over in principle, demand a refund as well as a PIF letter. For the ones you still owe on principle(include all interest you have paid on these) set up a payment plan for the remainig principle on YOUR terms. This whole forum is here for you. I had 4 pdl's. 2 with tribals, and 2 with carribean companies. Both tribal lenders have sent me PIF letters and the 2 carribean companies are still out there, but I have cease and desisted one of them already. .

Have received Paid In Full responses from the following companies:

Everest Cash Advance (have followed up requesting refund for overpayment)

Integrity Advance (also following up on overpayment...this is a DE company and have had luck with the DE BBB *see Eastside below)

Eastside Lenders - At first they were very difficult and refused all offers, wanted to work out the original amount due. And then I contacted the DE BBB and filed a formal complaint, asking for a paid in full status and refund of overpayment. Within 2 days I received a paid in full acceptance through the BBB but they did not address the refund. I sent in a counter offer and asked for my refund. Doubt I will get it but after looking at my 10 loan history with this company, I figure they owe me BIG.

Also received settlement offers from:

One Click Cash - I accepted this settlement because they only want the balance of the principal due which is what I told them I would pay.

Received a settlement offer from Ameriloan but rejected it because they are asking for another $150 to consider my account paid in full and I've already overpaid principal by $350.00. So I sent them a counter offer asking for a paid in full and refund or I will pursue my complaints with the FTC (and sited some tribal payday loan investigations that they currently reviewing) and my state government. I will also pursue the BBB and whether they will touch tribals.

I've gotten several calls from Payday Nation (in the UK) and although I've emailed them numerous times, they refuse to acknowledge my notification for ACH revocation only saying I will incur further fees for each NSF received from my bank (I closed my account). I have a feeling this will be the difficult one and will be contacting the FTC for advice since they are overseas.

Only company I have not heard back from is US Fast Cash. I owe them $65 on principal and have told them to provide me with details on where to send it.

All in all, I have to say although I was VERY nervous at first, standing up to them is the best decision I have made and I'm only sorry I didn't do it much, much sooner! Live and learn I guess. If you are on the fence about whether you should do this or not....DO IT! You are in the right here and the fact that these shady people are folding so easily is the only proof I needed.

All of those are illegal in the state of NJ! You are required to pay off the principles, and that's it!! Check out Ohiogal's forum in the sticky forums on how to deal with them! Any help, ask!! Great people on here. I was in your boat a month ago. Now I have a full paycheck that's all mine!
