I have been getting a series of calls from someone named Cristian Monaco. The call came from 315 410 8771 (Syracuse NY area code) Stating the followinging, " weve been asked to speak with you before accepting a request to present a plaintiff with a criminal mischief charge Affidavit # 65240"

before I call them I wanted to knoe what is meant by his sentence. Does criminal mischief charge have anything to do with a debt collection?

I have been unemployeed for 8 months and have explained to a previous similar call that I am unable to pay until I get a job. :(


First they broke the law by threating you with a criminal mischief charge so I would file complaints with the FTC, your states AG and I would even go as far as filling a police report with your county sherif. Second I would demand that they validate the debt they say you owe. Did you take out any payday loans in the past? If this is for a payday loan I would verify if the original lender was operating legally in your state. If the lender was an illegal lender, and chances are they were because they are using this bottomfeeder of a collection firm, you will only owe the principle on the original amount of the loan minus any fees and interest that you have already paid.

i can tell you that from this call that this is a complete bottomfeeder.the affidavit number is bogus and so is the idiot who called.i would do as tousi76 advised.use any info you have on them.name of their scam,and/or ph number they gave to file a police report.then also file AG,AND FTC complaints.then ignore them as really what will come from you calling them?threats and bullying in an attempt to scare you into paying.it's not worth your time.file the report and complaints knowing this is a scam of the first magnitude.
