Hello,
I have a problem with a past payday loan. It is from an internet company Quick Payday loans taken June 16,2005 for $420.
I just rcvd a call from a collection agency Capitol collection service (I think) they called and got my number from a family member. They said they were in the process of serving notice for a court date. It was originally taken out when I lived in NC but in the 6 years since then I have moved to FL. The individual stated they were gonna serve me with a summons and I would have to appear in the county where I once lived. And I did provide them with my current address and they said they would serve papers there. Is there something I can do about this and what should I do

As far as I know pdl laws will be applicable for the state in which it has originated. In your case it has originated in NC. So the pdl laws will be applicable for NC. Payday lending is prohibited in NC. It means none of the payday lenders in NC are legal. Illegal lender can???t take any legal action against you. Thus the collection agency will not be able to do the same. If you have any complaints against the lender, then contact with the North Carolina Attorney General. Their contact detail is as follows:

i want to make a few points here.

1)you got the loan over the internet in NC
2)pdl's are prohibited in NC
3)you move to FL
4)no internet loan is legal in FL unless there is a physical presence in the state.there is none for national payday
5)even if the loan was legal in FL.the SOL is 5 yrs meaning the debt is "time barred"
6)capitol is a piece of garbage that specializes in illegal threats to scare money out of people for illegal loans.

bottomline you will not be served and when the moron calls back.tell them you are filing a police report,and a complaint with the florida AG.then hang up,and ignore their sorry a$$.
