My bank won't allow me to do hard debits

I tried talking to my bank to get a hard debit hold on my/our account but they stated that I couldn't. What they could do is since these internet payday loans were deposited into our account that money would need to be returned to the payday loan company. That's the only way they could do it?

I should also mention that I bank with a credit union.


What state are you in, Trish? Which credit union is this? They really can do this, if not request it to be permantely closed. If these loans are not legal, say it is fraud (as they are illegal companies). This is why i am starting to think it really is best to tell the banks very little :(
Do you still have the money the lenders gave you? if so, than reversing it really is the best bet though I still would close that account out.

I'm in Iowa and it's Veridian Credit Union aka John Deere Credit Union.

Unfortunately no I do not have any of the deposit left as I have been paying the interest on these loans as well as our regular bills. I just want to be able to breathe a little ya know? Yes I got myself into this situation and yes I owe them their money back but at the same time they've taken well over the actual loan amount from my account and now I want to stop all ACH debits from my account so that I can just send them a money order to pay off the loans. I should have known better than to get myself into this predicament but at the time we were desperate for a little extra cash. tsk tsk on my part.

you are in iowa?then all internet pdl's are illegal.please provide the following.

names of each pdl.
amount borrowed from each pdl
amount debited total.

you mentioned paying the loan amount in fees.then you owe the pdl nothing more.please furnish the info requested.we can help further.i would look into a new bank asap before you are overdrawn on this account.

Just print out the info below and take it into your bank. Another question, did you speak to the branch manager, usually they are the only ones who are authorized to place a hard debit block, the tellers usually don't even know what one is. I've even run into a bank manager who wasn't aware of the EFT revocation law. Just sayin'! :D

?? 907. Preauthorized transfers

(a) A preauthorized electronic fund transfer from a consumer's account may be authorized by the consumer only in writing, and a copy of such authorization shall be provided to the consumer when made. A consumer may stop payment of a preauthorized electronic fund transfer by notifying the financial institution orally or in writing at any time up to three business days preceding the scheduled date of such transfer. The financial institution may require written confirmation to be provided to it within fourteen days of an oral notification if, when the oral notification is made, the consumer is advised of such requirement and the address to which such confirmation should be sent.
(b) In the case of preauthorized transfers from a consumer's account to the same person which may vary in amount, the financial institution or designated payee shall, prior to each transfer, provide reasonable advance notice to the consumer, in accordance with regulations of the Board, of the amount to be transferred and the scheduled date of the transfer.

Regulation E
Section 205.10 Preauthorized transfers
Requires financial institutions to provide the consumer with some form of notice that electronic transfers that recur at substantially regular intervals, such as the direct deposit of salaries or benefits and the preauthorized payment of bills, occurred as scheduled.[/samebox:77cbe3147a]

If your bank offers ach transactions then they also provide a way to block them.

You need to talk to the "manager". If you already did and he/she told you that you could not do a hard debit block they are wrong. They either dont know how to do it or just didnt want to. So go higher up. You need the name of their boss.

You have the right under federal law to revoke any and all ach transaction agreements at any time you wish. Tell your bank they will be violating federal law if they do not let us revoke.

Okay I've got the pdl's that I've gotten money from the internet.

Atlas Money Online - $300 they take out $90 bi-weekly
Loan Shop Online - $100 they take out $15 bi-weekly
Everest Cash Advance - $250 they take out $30 bi-weekly
SSM Group - $250 - they have taken out to date $350 until I stopped ACH debits from them

bea2ls I have calculated the payday loans that I have and here's what I have come up. None are overpaid so I know that I still owe money and I intend to pay but anyway...here they are.

SSM Group - $250 loan have paid a total of $225. I owe $25
Vince Enterprises - $250 loan have paid a total of $150. I owe $100 (forgot about this company)
First West Coast - $300 loan have paid a total of $180. I owe $120 (also forgot about this company)
SCS Processing - $200 loan have paid a total of $90. I owe $110
LoanShop Online - $100 loan have paid a total of $45. I owe $60
Ace Cash Service - $200 loan have paid a total of $0. I owe $200

Man that's a lot of pdl's and all but 2 are still taking money out bi-weekly.

Can I just send them a check for the remaining balances that I owe along with a letter stating that? Or is there another way to go about doing it?

after your account is secure, i would send letters out with your state laws and requesting payment arrangements. send this certified to their physical address (or email from a non work computer, do not fax from work neither). Do not send a check, send money order only (i prefer from the post office, easy to track!) and do not send anything until you get the arrangements that you request in writing.
