Hearshe Kemp LLC contacted me regarding a payday loan from 2006. At this time in Dec 2010 I was going thru alot with my vehicle, money and I have kids so trying to figure how I was going to make christmas happen was an issue too...so without asking for a copy of the electronic agreement. I set up payment arrangements with Kevin Sledge who was a charmer and said all the right things. They sent me an ACH authorization form with the payment dates hat the funds would be taken out of my account. On two occassions funds were withdrawn from my account prior to the dates set up...HEarshe Kemp blamed it on the payment system. The deal with Kenneth Sledge was after my last payment arranged at that time was made I was to wait unitil tax time and call them back to see if they would settle. Well on March 10 they start debitted my account again without authorization. I contacted Kenneth Sledge and he turned into a monster on the phone stating they could do that, and they sent a letter out to me and the money that they withdrew was not going to break me and after we were going at it for about 5 min he just transferred me to a Mr. Cooper who has yet to return my several voicemails. I immediately contacted my bank and cancelled my debit card. At this point I googled Hearshe Kemp and found a bunch of scam reports on them and they named Kenneth Sledge as well. Well after numerous voicemail msgs to Sledge and Cooper, I get a letter in the mail from Hearshe Kemp on 4/25 stating they are transferring my account to an atty office and they will pursue legal action. I contacted a Mr. Davenport who is suppose to be in the finance dept for Hearshe Kemp and he pretty much gave me the run around. I really don't remember back in 2006, the payday loan company Cashnet Payday loan company is whu they cliam I got the loan from but when I google them to see if I can get in contact with them, the search pulls up a lot of payday co that can not be directly contacted. Can someone please give me some advice. I am scared they will take legal action but I am also thinking I have been scammed. I read the laws in Va and what I am reading they have to follow Va laws. Mr. Davenport told me no they do not and he stated they can not provide a copy of the agreement and I should have saved it. Please advise me what I should do?
