How can I work out a repayment plan with these hoodlums?

Please tell us who they are how much you borrowed from each one and how much you have paid each one. I am also in Florida and have been helping others here along with myself regarding these companies. If they are IPDLs do not speak to them. Tell them they are to communicate by USPS only. Some will some won't. Those that harrass the worst are generally the most illegal of the group. Storefronts like Amscot are generally professional and are governed by strict laws in Florida. They will work with you.

All my pdls were online. I'm ashamed to admit that I have 11.
paydayok, loan shop, arrowhead investment, quickest cash advance, payday select, united cash loans, payday loan yes, cash direct express. All have varying amounts, but the oldest are paydayok and payday select. I have been paying them for months.

Frogpatch is in Florida and knows his stuff. I'll post Florida pdl law for you just to take a look at. They are all internet, correct? Don't be embarrassed or ashamed about having like 11 of them. Hell, I had 12 when I first came here. It doesn't shock us in the least. No problem. If you can post the information I asked for, we can go from there. The FLDFS is using the Florida Consumer Finance Act S. 516 as a possible law applying to these companies in addition to and possibly superseding the laws posted above. This is new info obtained from the FLDFS. I receved a refund from Payday Select myself. It was not asy but it can be done. Remember, pay no attention to their threats. None of the companies are licensed to lend here and are virtually powerless to do anything to you but harrass. I have heard that Florida has a suit against United Cash Loans. Arrowhead can be real annoying! You are in pretty good shape here from what I have seen so far.

I am in Florida too and have dealt with United, Payday Select among others. I faxed a letter to them, if you want a copy, PM me and I will send it to you. Payday Select was EASY! They emailed me saying that they are sorry that I am unhappy with their services and to consider my loan paid in full. I hadn't even paid off the loan amount it self. Impact cash wants to work out terms on the balance of the loan. They took off all the fee's that I had paid so far. 500fastcash is alittle bit meaner, but you know what I can be just as mean. Thanks to all the kind people here on this site I have the courage to stand up to these fools. I have also benn dealing with Sandra Smith. She will help you alot. She told me that they have a case worker that has two pending cases against United Cash Loans. If you want to contact her I will also give you her number. If anyone else here in Florida would like to speak with her, let me know and I will get you her number. I will be gone till about 7pm but will be back on then. Let me know.

Here is some more food for thought about the banks. My branch manager at Wachovia, told me that NSF'S for banks draw a hugh amount of revenue. He told me that each branch is allowed to refund only so much in nfs's to clients. This is BIG money for them. They make millions a year off of this bank fee. has anyone ever used their debit card and noticed that it goes into a "hold status" ? so, you get your balance the next day, thinking that amount had already come out and you now have a good balance, thinking that the previous debit has already been paid. Not so. Because the merchant hasn't actually come along and claimed the transaction, the bank will return it to your account. So here we go off to Wal-mart or where ever, buy some food or a new pair of jeans cuz we think that we are finally setting pretty good, money wise that is. You make your purchase, that one goes into pending staus. You figure that with those two debits coming out, you will have alittle bit left, just enough to get by till payday. Ok, it's thursday and you wnat to check your balance to see if you can stop and get some milk to take home. OH NO !! you are over drawn !! What the h-ll happened????? Because the bank put the first debit back into your account and hadn't actually paid it yet, then a day later the merchant comes along and reclaims the money. To make avery long looooooong story short.... you over drew your account cuz, the bank took the money out, but then put it back cuz the merchant didn't claim it right away in the first place. Are we confused yet?????????. Actually, you have been given a false balance in your checking account. Please, verify this with your bank. They all do this. It happened to me. It ain't pretty.

pat, please tell me you are kidding. I understand what you're saying. But what I don't understand is the part about the merchant didn't take their amount in enough time so the bank put it back in? What? How long does the merchant have to "take" the money? What? Call me stupid, but I find this really weird. But, then again, banks are in cahoots with pdl's in my paranoid mind! LOL! :lol:

cannr, it's true. When you use your debit card, the merchant puts a "hold" on the purchase amount. After a 2 day hold, the bank "unholds" it if the merchant has not put through their full transmittal. Happened to me.

Okay. Now we need another web site. One dedicated to the stupidity of banks. My good Lord. I know I keep accurate documents on my bank accounts so that I know exactly what is in there "for real" even if the debit hasn't posted yet. However, there are many, many people who go by the balance the bank states or what their receipt from the ATM states. I don't think this is "good practice" on the banks part. But I guess we could go on and on forever about banks! :lol:

I finally found a fax number for 500fastcash 800-361-5118. Fax your revocation of authorization to that number. Get a copy to your bank. If they deduct anyway, the bank has to refund it under Regulation E. Hopefully, the bank will block the deduction. Yahooooo - we be rollin'

About the bank thing... just make sure that those 'holds' from you debit card are finalized, not just in holding. When you have a 'debit hold', after 3 day, go and take a look at your account and make sure they got their money. As I had posted before... I was reading 'Yahoo news' a couple of weeks ago. The government is now looking into the fact that some banks are manipulating the order in which checks and debit purchases are presented. Let's say you have $100.00 in you account. Three withdrawals are coming out. $40.00, $30.00 and $99.00. All three hit at once. The bank looks at your account... hum... "we could clear the two items right away...... or.... we could BOUNCE the two, $40.00 & the $30.00 and PAY the one for $99.00. That way, we get $35.00 twice, instead of only once."
What do you think they will do?? It stands to reason that you goofed and didn't have enough in your account to cover all three, but, wouldn't you think that they would help you out by CLEARING the two checks so that you only will pay one fee of $35.00? Oh no.... that wouldn't benefit them..... This has happened to me.

I am from Florida. I thought i only had 4 pdls, but after reading some info, i also have one from Thinkcash, which they do not call themselves a payday loan company. The following is my info. I am ignorant and new when it comes to this. I could use some hand holding in what to do and where to go!
Advance America- store front-original loan $500. i have no idea how much i have paid to them. it's been so long
Think Cash - internet- $500- i have paid them about $300 so far
Emerald marketing- internet- $300- only paid $90 so far
United Cash Loans- internet- $300- only paid $90 so far
CashNet-internet- original loan was $300, paid that off for a total of about $600, then had to readvance for $500 to pay another loan. Have paid $120 toward that one so far (all interest)
I would appreciate anyone's help! I can't seem to get out of this endless cycle! Now i find out that most of these companies are illegal and i don't know what to do about it and where to turn. I am so glad i found this site. You guys are the greatest! :D

henry, no rollovers/extensions are allowed in your state. This is what your internet pdl's are charging you. Illegal. Ummmm.... you've probably overpaid some. Just looking, some of your internet pdl's are not even licensed/legal. Ummm.... your store front - different story. Store fronts are most likely licensed/legal. They follow the state law or get their license yanked. Do me a favor - can you post the pdl name, the amount borrowed and EXACTLY what you have paid so far? Not broken down into "interest" or "fees", because I'm not taking that into account since they are prohibited in your state. Can you put how much you borrowed and how much you paid exactly? That way we can see where we stand regarding the internet pdl's. Also, have you done anything with your bank account? Do these internet pdl's still have access to your account? When are the next debits due to hit, if so?

CashNetUSA.com- original loan was $250, i paid a total of $434.97. Readvanced for $500. Paid $116.12 so far. next due sept 4

I have not done anything with my bank yet... i can't close my account, because of my car payment. i got behind in that a while back, but had to set up automatic payments to be able to keep it. Is there something i can do without closing my account?

Okay, henry, here's the deal. I did some searching because CashNetUSA is quite an issue with a lot of people. Apparently, the are licensed/registered as a CSO in Florida. This means they are legal (unfortunately). And this also means that basically they can rob you blind regarding the "fees". CashNetUSA is a tough one. Since they are "legal", I'm afraid you're stuck with them. I hate to say that, but that's what I've found. We have a lot of Florida members on here. I'm sure they'll put their input in. Your other internet pdl's, I do not believe are licensed/legal. Like I said, I'm hoping a Florida member will come along & clarify more for us. I'm showing you still owe Think Cash 320.20, still owe United Cash Loans 210.00, and Emerald still owe 210.00. Now, I know for a fact that United Cash Loans is illegal. Totally illegal. They should not even be lending. I can almost be positive the others are illegal also. CashNetUSA is the only one that is showing as legal. Normally, I would say close that bank account now and open a new one at a different bank. However, you've stated you can't close your account due to your auto withdrawls. Also, I don't know about closing it since CashNetUSA is legal. Hell, henry, you've got me stuck here! LOL! :lol: I'm going to pm a couple of our Florida members and see if they can jump in here and help us out. Do not worry. Just hang on! Frogpatch is in Florida and he's good. I can message him. You can still close your bank account even though Cashnet is legal. What you will have to do is contact cashnet and make payment arrangements of some sort with them. Most likely they will refuse until they see the account is closed. Then they will tell you the other forms of payment that they will accept.

henry, I'm going to say close the account. If it's okay to close it with your CashNet, as posted above (that was the one I was concerned with), then close it before the internet pdl's hit again. You have time, which is good. You need to stop them. Two things working on your side - your state prohibits rollovers/extensions (which they are charging you) and your law states criminal action prohibited. Have you read the "sticky" at the top of the site page regarding closing your bank account? You need to read this. When you go to close your account, you will need to go to the branch where you opened the account. You will need to speak with the branch manager (not a teller - I learned this the hard way). You need to tell them to CLOSE the account. Also tell them to guarantee you that no pending pdl debits will "force" your account back open. If this happens, your pdl debits will hit and you'll be hit with NSF fees for them all. Learned this the hard way, too. If they can NOT guarantee you that your account will NOT be "forced" open, make them put a hard debit block on the account. A hard debit block will prevent anything from going through. ACH debits, electronic checks, paper checks, etc. It also means that you will not be able to use your ATM card or write checks,etc. So you need to open a new account up so that you will have access to money. Go to a different bank and open a new account. It's just safer going to a different bank. Get your branch manager (if at ALL possible) to give you something in writing (even an email) that your closed account will not be re-opened or that no debits of any kind will go through if you have to resort to just a hard debit block. The reason you want EVERYTHING blocked is because your pdl's (and I see one in particular) will use a different name, a different debit amount, a different date, etc. to try to get money out of that account. If they can't access it with ACH debit, they will send through an electronic check. They are very slick and sneaky. Read the sticky regarding closing your account. Read what I wrote about closing your account. Then post to us if you have ANY questions regarding that. I want to get your bank account straightened out and your money safe. We can then proceed and get some letters sent out to these people and file some complaints. Okay? So post and let me know where you stand, henry! :D

henry, please do. If your bank gives you any trouble, please post and let us know. Do whatever it takes to get that account closed. Stress fraudulent charges, stress unauthorized debits, stress illegal companies. Tell them you are working with your state AG regarding these companies. This usually gets their attention. Tell them you're working with an attorney. Tell them whatever. Just as long as they CLOSE that account and assure you that it will not be forced open. I have to say, I advised one member to be "franctic" about the whole ordeal & if she had to, have a "hissy fit" or break down in tears! God love the girl! She did, the bank closed her account, she got it in writing that the account wouldn't be forced open. She did great! Do whatever you have to do so that the pdl's won't hit, you won't get bank fees added on, etc. I told them I was "working with an attorney regarding these illegal companies." Opened their eyes up a little bit at the time. Not to say I didn't have a "problem" pop up later, but it got resolved. Please, let us know how it goes. We're waiting to hear a "success story" from you! :D

With the excepetion of Cash Net who, as previously mentioned, is regisered as a CSO here, the companies who loaned you are not licensed to do business here. The Florida Financial Act is being used as the law pertaining to these companies which makes the debts virtually uncollectable in the state. Florida is also a non garnishment state. So you are bound only by a moral obligation to pay these companies back. If they continue to harrass you file a complaint with the Florida Dept. of Financial Services @ FLDFS.com. I also urge you to write to the CFO of Florida, Ms. Alex Sink, and implore her to take a stance against these companies and also to stop them from posing as Credit Service Organizations when they are clearly not. I have personally written two letters to her and she has not replied to either. Make her live up to her promise of being there that got her voted into that job. She obviously is already losing touch with her constituants. Companies like Amscot and other storefronts are held to the strictest of laws here in Florida and the IPDLs just show up and trash them.
