I live in New York and got a loan from western sky for 2600 I made 2 payments before coming across this forum and learning that the loan was an illegal transaction. As per the details in this forum I revoked their ACH privileges, closed my account and informed them that the loan was illegal and i was willing to pay only the principal borrowed. I received the standard reply email and hard copy response about the loan being governed under tribal law. Now today I have received via postal mail a payment stub for next months payment as well as this month's returned payment and the resulting late and nsf fees. What should I reply to them and should i send it postal mail as this is how they are now communicating with me

Make it clear that you are not screwing around - the only way you will continue making payments is at your convenience and to the principal balance only. Also make clear they need to delete themselves from your credit

I actually did send my initial letter to elissa and received the standard form letter response. I have replied to her indicating that I have received her company's correspondence. I have also cited to her that I am aware of the ongoing lawsuits by various states regarding these loans as well as the FTC suit where they state that the tribal law does not hold jurisdiction over non members of the tribe. I guess all i can do now is wait for her response and see what happens
