I already submitted a thread, but it was deleted or lost.

I'm in Illinois. I have the following "loans" (I never applied for three of them but they deposited $ into my account anyways):

VIP Loan Shop: $400 loan, paid $240
United Cash Loans: $400 loan, paid $240
Nationwide Cash: $300 loan, $0.00 paid
Credits Cash Advance Network: $300 loan, $0.00 paid

I do not believe any of this vendors are licensed in Illinois, and their terms violate state law.

I plan on paying back the principal they deposited into my account, but I closed that checking account, opened a new one and don't want to give them the routing and account numbers: ACH and check payment is out.

I wish to repay these illegal vendors via cashiers check or money order, but I can't seem to find their physical addresses. Does anyone have contact information (phone number, email addy, mail address) for any of these companies? I have used the search option without much luck! Should I filed complaints with the BBB, FTC, and IL AG? I have yet to do so.

Any advice would be greatly appreciated!


I'm not done, but this a letter I'm going to write to VIP Loan Shop:

Dear Sir or Ma???m,
Please find the enclosed Cashier???s Check for the repayment of the money your company placed into my account. Your company deposited $400 into my account on 11/200/2009. As you can see from my bank records (enclosed), I paid your company $120.00 on 12/1/2009 and $120, leaving a balance of $160.
[FONT="] As your company is not licensed to operate in the State of Illinois as required by 815 ILCS 122 (relevant parts enclosed), your company cannot legally enter this type of contract nor legally enforce such a contract in the State of Illinois. [/FONT]
Each violation of this Act is punishable by a fine up to $10,000. For example, the State of Illinois fined Affinity Credit Services $273,000 for operating without a license, and Americash was fined $190,000 for charging fees higher than allowed by ILCS 122 (relevant government press release enclosed).
Failure to accept this payment as settlement of this account will result in the filing of complaints with the Better Business Bureau and the Illinois Attorney General???s office. I hereby request a Paid In Full receipt up your company received this money order.

No, No, No United cash loans is not immune. you can fight them. Dont let them fool you. you need to file a complaint against them at www.ic3.gov. they still have to answer to Federal Law and the more we complain the better our chances are at getting help. Right now several States are fighting their claims of being immune. So dont give in. pay just he principal back to them.

The case is Ameriloan v. Superior Court (People), 08 S.O.S. 6711. December 2008
Payday loan companies owned and operated by Indian tribes for tribal purposes have sovereign immunity and are not subject to legal actions to enforce state laws regulating the business of lending, the Court of Appeal for this district has ruled.
Div. Seven Monday granted a writ of mandate sought by five companies asserting tribal immunity in an action brought by the California Department of Corporations. The panel overturned an injunction and sent the case back to the trial court for a determination of whether the relationship between the tribes and the companies satisfies the requirements for immunity.
The department sued in June of last year, charging that Ameriloan, US Fast Cash, United Cash Loans, Preferred Cash and One Click Cash had ignored its “cease and desist” orders and were violating the Deferred Deposit Transaction Law by lending without state licenses and charging excessive fees, among other ways.

Nope, not true. I spoke with the Department of Corp in California (where I live) and the courts didnt say they are immune whats going on is the PDL has til May 2010 for the next court date to prove they are owned by the tribes and not a rent a tribe. And according to the Department of Corps it looks like they wont be able to do it. So it is still in court and as of now they did not win in court. You need to file your complaints. So dont give in.....

Yes, Unitedcashloans is part of MTE, but the point the Department of Corp is telling the courts is MTE is a rent a tribe.... They are only saying they are part of a tribe is to get away with being criminals. So MTE has not proven they are ran and owed by a tribe from the start. Thats what the courts are currently looking at. So make sure you complain cause the more complaints we file the more support the Department of Corps will have to prove they are criminals.....And VIPLoanshop is not better, I am dealing with them now. So dont be suprised you get a call from PDM Associates saying they have a case file on your loan and want to collect. Be prepared.
