Your employer needs to do some research about wage garnishment vs wage assignment. Wage assignment is totally voluntary and can legally be revoked at any time. Thus they should NOT be holding wages. No court order is coming....this is not a garnishment.

Wage assignments are voluntary and can be revoked at any time. You need to let them know that they are breaking the law by not releasing your wages and can get in some serious trouble. They should consult with counsel.

it doesn't matter as wage assignments in IL are all voluntary.meaning even with an actual signature you should be given an opportunity to revoke this assignment.as all have stated it is not a garnishment.your employer is risking you suing them over this.btw IL ceiling on this is 15% after all other deductions.print up the laws SOAPLADY posted and give them to your HR person,and boss asap.

I looked at the laws and it does not say anything about revoking after the assignment has already been put in place. I did not get my revoke letter to my employer within the time frame they allow the 20days or 5 days. Does that make a difference?
