Need help with CashCall and other PDL's
Date: Wed, 06/12/2013 - 02:33
They have been calling me non stop and sent me a letter in reply to my letter stating that I was responsible to pay back my loan and that the loan was originally funded by Western Sky and that Sioux tribal law excludes them from being licensed by any states. They sent me my contract also that I agreed to online.
I also have these loans I am dealing with: (I have already sent them the letter from Soap Lady regarding the lenders not being licensed in the State of Michigan).
American Web Loan $600.00 paid back $180.00
Plain Green Loans $1000.00 paid back $478.38
Mobil Loans $1050.00 paid back $737.50
Sure Advance $400.00 paid back 82.66
Blue King $400.00 paid back 0.00
Mambo Loans $300.00 paid back $135.00
Everest Cash Advance $300.00 paid back 165.00
Mambo Loans and Everest Cash Advance I never signed any agreement for their loans. I had filled out a form on a cash advance website and they must have gotten my information from that site and deposited the money into my account.
Mobil Loans and Plain Green Loans continue to contact me regarding my past due payments and have ignored my letters.
I need advice on how to proceed with these loans and the best way to pay them back without the interest. I don't want to give them my bank account information. I also don't have huge chunks of money to pay them all at once.
I need to do something asap about CashCall. I have read on your forum that you say not to contact them by phone, but, they keep calling. I am concerned that they might contact my employer and I absolutely do not want that, nor do I want a negative mark on my credit report.
Any help you can give me would be greatly appreciated. Thank you.
All of your lenders are
All of your lenders are illegal in your state. You are required to pay them only the principal. No interest, no fees. You should close down your old bank account and open a new one to stop debiting money from your account. Don’t worry, illegal lenders can’t report to the credit bureaus. Don’t share your personal information with them. Ask them for the refund as you have paid them more than the borrowed amount. If required, file a complaint against them to the SAG or FTC.
Cash Call
I live in Michigan and I took out 1000 loan from Western Sky. They immediately sold my loan to Cash Call and the loan amount was for 1500 although I only got 1000. I would like so send the illegal loans letter but I was wondering how much refund should I ask for? I paid 2689 on the loan. Should I subtract the 2689 from 1000 or 1500?
@mariuswilson - Western Sky
@mariuswilson - Western Sky is a tribal lender, and Cash Call is servicing the loan - they would have to be licensed to lend in MI to lend to you - you can check with Michigan Office of Financial and Insurance Services to see if they are - but willing to bet they are NOT!- Follow the steps on how to deal with in my signature below - all in order for best results. You will subtract the $2689 from the $1000 - so amount over paid would be $1689 - you will not get a refund, you will be demanding a PIF.. You will get lots of mail from CashCall - important to never send anything back to them, just file away..
Once we get you on your own thread - I can copy this info over for you... :)
Thanks for the reply
Should I put in refund request and then take PIF if they won't refund? Thanks again
You can - but WS/CC will not
You can - but WS/CC will not be doing a refund... I would put demand a PIF and then also request refund...
Response from Cash Call
I sent my ACH revocation letter to Cash Call and I got a letter in the mail from them and part of it states:
Western Sky is licensed by with the Cheyenne River Sioux Tribe. Western Sky does not have any physical presence in your state or any other State of the Union. The laws of the Cheyenne River Sioux Tribe apply exclusively to the terms and conditions of your loan and you further accepted this choice of law and jurisdiction by executing your loan document. These facts were explained to you when you applied and again when you signed the Promissory Note.
At no time did you ever indicate that you didn't understand the terms of the contract, the jurisdiction of the note, interest rate charged or total finance charge on the loan. Moreover, had you relayed an adverse financial situation to Western Sky customer service, you would have been offered a very favorable resolution despite its lawful rights to enforce the terms of your contract.
Does this mean anything? What should I do now? The Consumer Financial Protection Bureau called me back and I gave them all the information that I could about the situation with Cash Call
It is them just trying to get
It is them just trying to get you to pay - You will get a lot of stuff from them trust me.. I have a whole file of crap... Just don't send anything back to them... if you have questions we are all here to help you just let us know if you get something you are unsure of.
Who did you borrow from
Who did you borrow from Western Sky or Cash Call.. Western Sky is tribal lender - what state are you in? They do report and you will have to fight to get it off your credit.. Cash Call is only servicing the loan..You will want to see if either are licensed to lend in your state.
Sorry forgot - RI right new
Sorry forgot - RI right new laws/guidelines protecting you all more -- Great news on that.. Cash Call is technically only servicing the loan -but they and WS are one in the same.. So you are protected either way.. You will just need to start disputing - can take sometime - one bad thing will not kill you though..
More Cash Call
How do I get Cash Call removed from my credit report? Also, I keep getting offers to bring my loan current and to sign some documentation. Should I still ignore it?
You will have to dispute with
You will have to dispute with the credit reporting agencies. Do not sign anything from them. Simply ignore!
You can go directly to the 3
You can go directly to the 3 credit reporting agencies website, Experian, Equifax and OMG my mind went blank on the 3rd one. Anyway google credit reporting agencies, this will bring them all up and fill out the form on their site to dispute. Geez...Just remembered the other agency is TransUnion. I still have a few brain cells left :)
@mariuswilson - You will get
@mariuswilson - You will get lots of mail from them - just file away - important to not return anything to them - what kinds of things are you getting? if you read over you will notice they are referencing a loan you have with Cash Call - you have not done a loan with Cash Call - it is their way of getting you to sign something to say you did..
