You received a loan from us, we are not located in your state and a very much aware of our rights and the law to collect monies that were borrowed by you and we would suggest you Read Your Contract. Contact the Collections Department as you were given the correct e-mail address to use. You were given both a phone number and an e-mail address to use and you were living in that State when you took the loan, Read You Contract, again.

Here's what I got again.
Again, as indicated in my original email we only accept electronic payments. Your other payment option is Western Union.

To confirm this payoff you will need email back and specifically confirm this payment arrangement as listed above. Once you have done that I will email you with Western Union information.
This is a loan payoff, meaning once you confirm payment your account will then be removed from the collections process, your balance will be frozen and no further charges will be assessed on the loan balance as long as you follow through with the agreed arrangement.

No they can't. Subpeonas are issued by courts, congress and other government agencies, not by scummy payday lenders.

If you've read any of my other posts you might have noticed that I mentioned one PDL who called me pretending to be a collection agency. That lender was P-L-Y. The genius who called left a voice mail message that contained several violations of both the FDCPA and PA's Fair Credit Extension Uniformity Act. The funniest part had to be when he compared me with dog do-do. Of course, I saved the message (after I stopped laughing), filed complaints with the AG and FTC, and then sent P-L-Y the following email:
I have previously been in contact with you regarding the illegality of the payday loan you allege I owe you. I have made it quite clear that I was only willing to repay any prinicpal balance less any payments already made.
However, let me restate that position. As of Februaury 2 2009 it became illegal for lenders who are not licensed in the Commonwealth of Pennsylvania to issue payday loans over the internet to PA residents. This regulation by the PA Dept of Banking has already been upheld in court, and I notice that most payday lenders no longer issue loans to PA residents. Since you have issued me an illegal loan, you have violated PA law.
I recently received a telephone call from someone who identified himself as "Kevin Andrews" from "First National Services Litigation Department". This gentleman foolishly left a very abusive message on my voicemail. Be advised that I am aware that "First National Services" is a bogus name that your employees use when making collection calls. Be further advised that I also know that both the telephone number the call originated from as well as the 800 number left in the message belong to your company. Additionally, I also am aware that your actual business location is in Wilmington, Delaware.
This phone call was a clear and egregious violation of both the Fair Debt Collection Practices Act and the PA Fair Credit Extension Uniformity Act. Be advised that I have permanently saved the message as well as documented from my phone records the date and time of the call. I have also filed complaints against you with the PA Attorney General's Office, both for the illegal lending and the abusive collection practices.
I am also aware that there is absolutely no legal action your company can take against me. There is, however, legal action I can and will take against you for your violations of the above-mentioned laws.
Accordingly, I am no longer willing to enter into any repayment plan or pay anything on any debts you allege I owe you. I further demand that you IMMEDIATELY CEASE AND DESIST ALL CONTACT. This includes contact from your company, any bogus collection agencies you may pretend to be, as well as any actual collection agencies you may employ. If you fail to adhere to this demand, I will not hesitate to proceed to sue you in a Pennsylvania court of law.
