Yep, its a scam. It is illegal for them to threaten you or bother you at work if you ask them not to and they HAVE to provide proof of debt in writing if you ask for it. See the better business bureau website for further info on correct collections procedures. They called me at work and threatened me and had me so upset I was shaking. When I went home my husband called them back and asked for a physical address to give to our attorney. They hung up and never called again.

I recieved a phone call this PM from a number that just read as INTERNATIONAL on my caller ID. It was an obviously Idian fellow claiming to be with LEGAL BACK OFFICE and stating they needed to speak with my husband regarding charges that were being filed against him by INSTA CASH. We have never recieved any loan from INSTA CASH or any company affiliated with INSTA CASH. He asked if he could verify my husbands last 4 of his social, so I said sure and the info he had was not correct. He did however have our correct street address. I asked him for his companies mailing and physical address and he just kept trying to make me take a number down. I hung up on him. Googled the afore mentioned "legal" company and did find a website but none of the phone numbers worked and the number from which he called didnt work when I tried to turn it around and call it back. Further googling lead me to several blog spots where tales of instacash scams are amuck. Im not worried, I know the laws and right surrounding payday loans anyhow..just thought I would share. Dont be worried, even if you did have a payday loan of which you defaulted you can not be thrown in jail and there are no felony charges only civil actions (wage garnishments) that can be taken and that is if your state will even allow that.

I am so glad that you all had this on here. I received the same kind of phone call. They kept asking for my attorney's number and then said their investigators were going to come and talk to me. I told them I had received nothing in the mail and this was the first I had heard of it. I think I made them frustrated because I just kept calling them back and they never could tell me what county they were filing these charges in, if it was federal or state etc. I was stressed for a minute, but now feel better after reading all this.

I received calls like this a few months ago, and then again today. They claim that I had been sent 15 emails regarding delinquent amounts, which I never saw and are not in my junk folder. They cannot tell me the email address that the emails were supposedly sent from. They also cannot tell me which of "InstaCash's" many lenders have brought the charges.
They claim that criminal charges are being filed including "check fraud". I have written to InstaCash, but don't expect to get a reply. Should I ignore them or try and get more information from them?

I got the same call today informing me that I had criminal charges pending against me due to an unpaid payday loan. I was told that the company had tried to contact me and decided to pursue the matter through the courts. The gentleman read the complaint so fast I had a hard time following what he was saying. He got real rude when I started asking questions and got down right belligerent and threatened to have my job taken away and that I would loose my house in the end. The he hung up on me.
I called back and got a woman on the phone and the she told me that I had no right to deny the claims and that I was going to loose my job if I didn't pay up. She finally told me the name of the company - Insta Cash and the amount and the date the money was supposedly deposited in my account. I checked my my bank records and couldn't not find a deposit made by Insta Cash.
A call the the state department of financial institutions let me know that this was a scam. A search all over the internet has proved this to be true.
I'm ready for them next time.

This is the second time I have heard from these people in the past 3 months. I hav'nt had a payday loan in over three years. My husband at the time, he has sinced passed away, had no work whatsoever. I received one for about six or seven hundred dollars. When he passed, I had a lot of debt to clean up. But, this past loan had been paid. These "Instacash" people had the names and phone numbers of my two best friends, not to mention the fact they somehoq got my new cell phone number, address, ect. I had even moved halfway across the U.S. at the time. All of their information was correct. That was scary enough.
I was also told what I was going to be charged with. I seem to find that by reading all of the reports on these people that they always ask if you have an attorney. I am so ready for them this time. If you say you have a lawyer it's over for them.
Note for people with these experiences:
The law states you must be informed that the person and or company you are dealing with is attempting to collect a debt. You have the right to request all documentation in writing, they have an obligation to fulfill that request.

I must have laughed till I cried! For one, you have a right to be informed of the debt brought up in Civil Court....not criminal. Second, they would not tell me what county court I was to appear before and Third, they were clearly foreign with Americanized names.....Donald Williamson? Really?! So guys don't sweat this stuff....If we all pull together, I'm sure we can find these guys and put them out of their misery. The scary thing is that they do have personal information...but if you have a identity theft partner behind you, you'll be fine.

Jeanette, I have not had personal dealings with "Instacash", however, if I were you, I'd do more investigating of your own before anything else happens. Don't give them any of your personal information, or if they already have it (you said they have references), ask them how they obtained it. Get detailed info about who you supposedly talked to, on what date and at what time. If there's a paper trail, then they will have to give you this information. ~JEN D.

got my call from these people this evening. saying that i was a suspect in a criiminal case. had all the info. i confess i was looking for payday loan which is probably how they got the info. they scared me so that i was shaking, but then bells began to go off my wife saw it first. then when they asked for a photo id it hit me too. i let them fin ish their speel and immediately began checking the net. came across these complaints. then went to local state police barracks for some advice. once i began talking the corporal just shook his head and said did they offer take a sum before they went to court. i replied yes. he said ignore it, i've heard of it before total scam. if they call again just say you reported them to the state police. after talking to him i was much relieved. the wife was right, i almost fell for it again..but she saved my bacon...

I just received a call at work from "David Wilson", an Indian man with a very thick accent. I highly doubt that's his real name. First let me say they would not transfer me to the correct extention without knowing my name. I asked why it matters if I know the extention and the name of the person calling me. I finally just said "Jenny" to get the ball rolling. I talked to "David Wilson" and he told me I had criminal charges pending and needed to take care of it by Friday morning. He said I rec'd money from Instacash and never paid it back and asked if I had an attorney. I told him I didn't because I don't need one. Right away I knew it was bogus and I told him that. He told me I was being "lippy" and transfered me to another Indian man. Oh, I was also told by "David" that I has to listen to everything without interruption and ask questions at the end. I could not agree to that. Ok so now I'm transferred and this guy is trying to tell me I owe this money and I told him I needed to know the company, the amount, and the date I supposedly got this money that I never repaid. All he could give me was a March 22, 2010 "charge off date" or some verbiage close to that, and that included interest, etc. I told him I didn't need to know that, I needed to know the company who supposedly gave me this money, the date of the deposit, and the exact amount deposited into my account because I knew this was all bogus. The Indian guy was a little riled and all I could make out was the word "bogus" before he hung up on me. This is a total fraud. Please do not stress about it and please do not give them any of your information. I am going to report this.

Got a call from 209-729-3813. A Jennifer Gray (who was clearly Indian) left a voice mail saying I must call WITH my Lawyer immediately. I tried calling the number over and over again and it was either busy, or a recording said "all lines are busy." They called back at 8:10pm (EST) and Jennifer Gray said I was named in a case and gave me 4 digits and asked if they were the last 4 of my SS#. I said no. She then asked me if I banked with Capital One and I said no.
Then she got weird and her Manager came on and said his name was James Freeman (he had a very heavy Indian accent). He gave me an e-mail address and asked if it was mine. I said no, because it was not. Then he repeated the same 4 numbers and asked if they were the last 4 of my SS#. I said no. He then seemed to get angry and snapped "Sir, it makes not sense that you keep saying no because this is the case we downloaded." I said, then you got bad information and he started to threaten me with Interpol, something called the Bureau of Criminal Control and some other BS. I said I reported THEM to the FBI because I already researched them and knew it was a scam. He became very angry and started yelling. I hung up.
This is a total scam. It is time U.S companies pulled ALL call center work out of India. Clearly, someone is selling partial or all information about us!

I received a phone call last week from a Brad Nelson "paralegal" of Brandon Benedict, stating that I am being charged with theft by check, among other things. They threatened to have the cops sent to my job and have me arrested if I didn't pay 644.39. I proceeded to tell the "attorney" that I have never received a payday loan that I would not pay that balance, until I did further investigating on my part. He also said this loan was from instant cash. He said that I have been notified several times through email and that if i didnt handle this immediately, i would have to fly to new york, with my lawyer to fight this in court. It's allllllll bogus!!! What criminal case notifies you by email and not certified mail or a subpoena???? He never could give me the exact amount that was supposedly deposited into my account or the day. He said that it was around $250-300 that was deposited and after interest and attorney fees it was $644.39. If he calls me today, i think i will tell him to kiss my ass!!!

Oh and not to mention the strong indian accent. I have a number that they called me from and also a number that I returned he call, both are different area codes and are non traceable. This "attorney" also, when trying to tell me what he was calling for, told me to shut up and listen and do not interrupt him until he was done. I also put my boss on the phone, whom told him not to call he office again, only to get a call yesterday from the same guy.

Wow I got a call from the same number too (818)584-7330. I was so scared that it might be true but i checked with my bank and have no deposits from insta cash. Now I feel a little more relaxed about everything all by reading all this things.

OMG! Do I feel like an idiot! I got 2 calls from 2 totally different scam artists this afternoon claiming I receive money from a pay day loan....I was SO freaked out because I had applied for a pay day loan a few months back and paid it...but thought since I did it on the internet (yes, a fool) I thought uh oh, did I get a small amount deposited and didn't realize it???? I panicked when they told me that they were going to download my file and send people to my house on Monday with all the court paperwork...blah blah blah. They couldn't/wouldn't give me ANY info other than InstaCash. I told them I went through all of my accounts and receive nothing...and that I could prove it! After I realized that this was all just a scam I decided to play with them and tried to get them to offer me some sort of settlement or at least a fax number where I could send them the proof and they wouldn't. I tried to get them to give me the details of the deposit, and the couldn't. I tried to get them to give me InstaCash's contact info and they said they didn't have it.....WHAT??? I said you're looking at an affidavit for a judgment and you don't have the name and address of the original creditor in front of you??? He tried to pull out of it and said it was illegal for him to give me the info!!! Since he was obviously not from America and could barely speak English, I asked, "Illegal? Really? In what country?" Ooooh that ticked him off and he kept threatening to send his legal team to my house...I told him to bring it on because I'm reporting them to the FBI....we'll see if they ever call back again....I'm never applying for a pay day loan on the internet again...what a FOOL I was.....just goes to show you, when you're desperate, you do crazzzzyyyy things......Now I have to block my accounts, maybe even close it and open a new one because I'm not taking a chance that these SOB's are going to extrapulate my hard earned money!!!!!

That's what is so puzzling to me...if they already have my SSN, bank info, name, address, phone numbers, etc what more do they need from me in order to get into my account to get money? I even tried to get them to offer me a settlement to avoid the whole summons/supoena thing (this was fictious on my part, I was trying to see what they'd do, I certainly wouldn't give them another thing). I can't wait until these people get on the radar and get shut down....

I just received about 6 different phone calls from this company as well....harrassig me and yelling at me. They told me that i owed over $8000. I have never taken out a payday loan, therefore i know that this is a scam. they called me stating they would come to my home and my place of business and that i should be very scared. does anyone know how to prosecute these people in India or where ever the hell they are calling from?? they call me from several different numbers telling me that they needed me to give them my SS# so they could send an affidavit to me. There is no way in hell i would just give someone my SS#.....they called again after i hungup and i told them look, calling from a different phone # is not going to make me give you any information so you people can rip me off, then they hungup. i tried to call back and that phone line had immediately been disconnected. i called back a previous # that they had called from earlier and once i started saying how i dont appreciate them calling me and i want them to remove my # from their call list, they hung up on me again. i tried to call back and it was busy. these people should not have the right to harrass us like this....this is getting beyong ridiculous. more ironic is that over the weekend i found out that i had fraud on my account and online transactions that had occured. i had to cancel my account immediately and then the next day i started receiving these calls. im going to be getting in contact with an attorney.
