Need help in California

I am overwhelmed with PDL's
I am in the process of closing my bank account as the fees are going to bankrupt me.

Please help me get out of this mess. Don't even now where to start.

I have the following:

And they tried to hit my checking acount on

Beware of Cash Tansfer Centers. They will send a wage assignment to your employer. You must send them a letter revoking it and give a copy to you payroll dept. I have posted a link below to Califonias laws regarding Payday loans. You have already paid off some of them legally. Cashnetusa is legal in your state so you must pay them off.

Ameriloan is illegal. You have already paid the principle on that loan.

Instant Cash Debits / MTE is illegal. You have already paid the principle on that loan.

You need to contact both of those PDLs and tell them they are illegal according to the laws of your state and you have paid the loan and at this time they owe you a refund.

Here is a sample template you can use. Just re-type and tailor it to your information.



You can email, fax or send certified USPS or all three. I only emailed mine.

Make sure your account is closed first BEFORE you send the letter.

Also make sure you file complaints with your AG.

I have to disagree with nobiogal on one point. Certified mail is the only way to go with most lenders. My experience is that they ignore anything else. Cashnetusa will ignore everything including certified letters. They are relentless and will turn you over to collections quickly. They would not even respond to my request to set up a payment plan.

Thank you all, for your help!! Glad I'm not the only idiot out there.

Should I notify Cashnet, CashTransfers center and American Consumer Credit,that they won't be able to process the payments coming due on the 11th. And if so, should I wait until my Bank account is closed, before telling them.

It's not like there are funds in the account to cover any payments anyways, but I don't want to incur anymore bank NSF fees. (I've already paid out well in excess of $300.00 in Bank Fees, due to ACH payments being refused)

coming due on the 11th of this month, Cashnet, CashTransfers center and American Consumer Credit?

I think American Consumer Credit aka Cash Spot is also illegal.

I don't find them on the CA license database.

What I would do is close the account. Then I would contact the legal ones and ask for arrangments. Don't be surprised if they won't make them then. Most won't until you default. After you default then contact them again or they will most likely contact you.

List the following information so we can help you.
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.
I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. Appreciate all the help you guys give in this forum. I wouldn't even have known where to start.

I have closed my bank account, so as of now, they can't get anymore from me. I've also shot off letters and faxes to all payday companies. The only one who replied was CashNet USA, and they are offering me a payment plan to repay what I owe. But I have to call them back AFTER my ACH withdrawal has been returned (which they say takes 3 days)

The others......no response. I Have received a response from BBB regarding Ameriloan and MTE and they are trying to contact them. They have till the 25th of Feb to respond. I have WAY overpaid both of them, but don't really expect to receive a refund. I know I will NEVER use pdl's again. What a scam they have going. Again thanks for your help

Can anyone who's a California resident give a "testimonial" of sorts about success that you've had using these "send a letter" tactics for Ameriloan?

Cashnet USA was very easy to deal with. They split what I owe them into 2 payments. of $125 each, so on the $200, I will be repaying 250.00. I have made the first payment, and they said that after they receive my final payment of $125 they will issue a PIF.

The Cashspot (American Consumer Credit) Immediately (within 3 days of default and receiving my letter) called me and said that they have "Written off" my loan and I no longer need to pay them. I'm not sure what to do about them, because I have never paid them any amount. Not even the principal, which I DO owe. How does it work when they "Write off" your loan?

The others - Ameriloan, MTE Financial/Instant Cash have not responded at all. I did file a complaint against them with the BBB, and am requesting Wachovia Bank (My now closed account, which they were drawing ACH withdrawls from) to investigate the monies removed from my account as fraud.

Is there anything else I should do at this point?

Hi sdolan1,

It sounds like you have your bases covered. ACC is easy to deal with, I had actually overpaid them and they issued me a refund w/no fuss. I also had a company that wrote off my balance and never contact me at all. Did the Cashspot also send you an email stating that they have written you off? If not, I would try to access your account online & see if you can print the page where it show's a 0$ balance. Ameriloan might be difficult to deal with, they gave me grief for a few weeks before we finally settled. I have never dealt with MTE, but from reading some of the threads they will be difficult also. Just hang in there and everything will eventually come to an end. :D
