Finally taking control, help needed.

I live in Ohio and fell victim to the internet pdl trap as well as the exponential increase of robbing peter to pay paul so I now have a lot of pdl out there. After reading these forums (which are so awesome and upbuilding btw, it's nice to know others have fallen victim to the same trap as I) I am closing out my bank account tomorrow and opening a new one. I have already been in contact with my credit union and explained the situation and they are being very cooperative and helpful. Here is my long list of lenders, principals, and amounts paid:

As far as i can tell none of these are legal in the state of Ohio. I am going to send out the C&D letters and demand paid in full receipts from the ones where the principal has already been paid or overpaid, and request refunds. I am going to tell the ones where I still owe some of the principal that I am willing to pay the remainder, only by money order via certified mail. Is there anything else I should be aware of or do? Also if anyone has any specific information on dealing with any of the above I would greatly appreciate it. This has been draining me for some time now and to know that there is a way out has lifted such a huge amount of stress from my shoulders. I know it will take some time, but knowing that I have started it, man does it feel good.

Payday lending is considered legal in the State of Ohio. You need to contact the Ohio Division of Financial Institutions in order to find out whether or not your payday lenders are licensed to operate in your state. So I have taken the first steps. The account has been closed out. I have sent out emails to the PDL's that I have paid in full requesting PIF receipts and refunds. Within minutes of sending them out I started getting the canned responses of them issuing loans from such and such a state, I signed a contract, etc. etc. I replied back with the PDL laws of Ohio again and stated if I don't get a PIF and refund I will file complaints with the AG, BBB, and FTC.

I did get one response back from PayDayWiz:

"We will notate on our reports that you wish to purposely default on this loan good luck getting loans in the future."

Should I consider this the best I will get from them or should I press for a PIF receipt?

It feels really good to finally be taking control of my life back!!!

I'm going through the same. I am about 3 weeks in so far. I've had some sent to collections, some have had threats but I haven't heard anything else, I've gotten the scam calls (guys with Indian accents. They were really actually fun to play with).

Had National Credit Adjusters call last night and I didn't take their BS. When I asked for thier address the guy put me on permanent hold.

Keep it up and push as hard as you like. The ball is in your court now. The more I keep at it the more I am going to push to get my refunds, which in some cases are $1000. I'm sure I'll never see that but if I get anything back (even 20 bucks) it will feel like a victory.

I'm going to also watch my credit report to see if these goofballs try to report anything.

And lastly, I am pushing for PIF letters so that I don't get collection calls for years to come with no proof of what was settled.

So I have sent out the remainder of the C&D emails to the PDLs to which I still owe some of the principal balance.

I have gotten responses from several of the first wave now, all of them have just sent me the first canned response of "You signed a contract, we will pursue legal action!" I have sent back appropriate responses. I cannot tell you how empowering this forum has made me feel after all this time of feeling so powerless. Having the knowledge this forum has given me gives me all the willpower in the world to fight these scumbags!

I will keep you up to date with progress.

Keep at it. I get the "we will do what we have to do" line at the end of every call.

So far all of the threats have been empty. The collector yesterday claimed to have sent me mail on 6/17 but I am sure I never got the letter. Because he never sent it!

Keep your cool and proceed as you are. You are in control now.

And I love when they end with how you should keep your account in good standing if you ever want a PDL again. Please, don't EVER give me a loan again!!!!!!!!

So I have some updates.

Just got another PIF from Sonic Cash :grin:

So far I have gotten 2 PIF, Sonic Cash and Payday WIz.

I have gotten Signmyloan to accept my payment to pay the remaining principal.

I have made arrangements with Cashnet USA to pay off the remaining principal.

I have not heard anything further from the others past the initial emails, but their withdraws are no longer valid as the account is closed, so we will see what happens over the next few weeks.
