Integrity advance $300 loan

Hi guys,
In July 2009 I took out a $300 payday loan with Integrity advance. I understood that there would be a $90 fee for the loan which is what I agreed to pay. They have debited my account 5 times $90 each, I called to find out what was going on and they said it's only going toward interest and not principal. I put stop payments on the ACH debits but they got sneaky and ran paper checks through my account in the amounts of $165 and $325!!! This caused my account to be overdrawn. So all in all I have paid an extra $550 in fees!! I am currently in dispute with bank of America because I did not authorize those checks, we'll see what happens. I also filed a complaint with the Delaware BBB, TN attorney general's office, and the FTC.

Question: I'm in TN, I've read a few threads on the laws. Correct me if I'm wrong but according to TN they can only charge $30 or 15% of the total amount correct? I want my money back!!! Any thoughts??


Did you find out what state they are actually licensed in? That would be the state laws you would follow because TN allows your residents to borrow from Internet lenders as long as they are licensed SOMEwhere. Sorry for the bad news. I am going to research to try and find out if they are even licensed anywhere, if they aren't then they would need to follow your payday loan laws, period.

I would just like to add, you really need to close out that account because now that they have your account number it will never be safe again. Open a new one somewhere else before you close this one, then close it asap! BOA isn't very helpful when it comes to following the EFTA law, you have to push and shove them to get anywhere. I would fill out a formal dispute to have your money returned on the grounds that you revoked their Ach's in accordance with the EFTA law, which covers universal debits! Then I would open a new account somewhere else, and NOT give that new account number to ANYone. I would say they are paid in full with all they have taken so far.

You should file a complaint with the Banking Commission and the FTC because financial institutions are required to adhere to Regulation E.
